Mrs. Turner moved that the minutes of the November 9, 10 and 12, 1998 meetings be approved as corrected. Seconded and carried.

County Clerk Barbara A. Frank read a letter from State Senator Joanne B. Huelsman acknowledging receipt of the Jefferson County Board resolution regarding funding for public library systems in the 1999-2000 biennial budget.

The communication was ordered received and placed on file.

The County Clerk read a letter from State Assemblyman David Ward acknowledging receipt of Resolution No. 98-61 regarding Jefferson County's concern for budget legislation for public library systems.

The letter was ordered received and placed on file.

The Clerk read a letter addressed to Chairman Wilson from Columbia County Board of Supervisors Chair, Mr. Robert L. Hamele, regarding unfunded tax liability owed the Wisconsin Retirement System by counties. Mr. Hamele stated that Columbia County is awaiting a decision by the State Attorney General which would allow them to borrow funds at a cheaper rate than that which is charged by Wisconsin Retirement. He requested that Jefferson County write a letter to the Attorney General urging expedient resolution of this matter.

Chairman Wilson ordered the letter placed on file and requested permission of the Board to write such a letter.

By voice vote, the Board authorized Chairman Wilson to send a letter to Attorney General James Doyle as requested by Mr. Hamele.

County Clerk Frank read a Notice of Public Hearing for December 17, 1998 from the Zoning Committee.

The notice was ordered received and placed on file.

No one was registered for public comment.

As a Special Order of Business Ms. Marilyn Haroldson of the Jefferson County Economic Development Corporation addressed the Board.

HIGHLIGHTS OF 1998 ACTIVITIES OF THE JCEDC

Workforce Development Center - site approved and construction of Center begins. JCEDC, funded by Jefferson County, is a partner with WDC in marketing the Center's services. Commitment to work in partnership on the Marketing Committee, creation of brochures, and presentations for local business and industry, government and education.

HOME Consortium Housing partnership with Washington and Waukesha County.

In 1997 the County Board signed a resolution to join the Tri County Consortium along with the cities and villages. This resulted in a HUD HOME grant of $840,000, July 1998. JCEDC is the active liaison between the Tri County Consortium and local municipalities. JCEDC initiated Lenders Consortium meetings. Provided support and assistance for downpayment programs, home rehab programs, and home buyer counseling.

Forward Wisconsin

Call Trips to Chicago; appointments with companies considering Wisconsin as a place to do business.

Partner w/Forward at the Engineers Design Show, McCormack Place, Chicago.

Partner w/Forward, DNR and UW at the Woodworkers Show, Atlanta, Georgia.

(Promoting the State of Wisconsin and Jefferson County as a place to do business.)

Discover Jefferson County Video "You Can Have It All" aired again to over 4,000,000 viewers.

Tourism Council initiated by the JCEDC, partnered with Chambers, professional organizations and interested businesses to develop a countywide tourism council and guide to be distributed to over 50,000.

Monona Terrace Grand Opening - promoted Jefferson County to 300,000 attendees.

Retail Trade Area Study - statistical study for services and retail business, UWEX and Research.

Revolving Loan Fund - studied for business attraction and retention opportunities, countywide use.

Utilities Forum - JCEDC organized forum. WI Utilities Commissioner, WEPCO, WPPI and other industry leaders address effects of industry changes, ISO, power shortage and energy issues of concern to employers.

Information Center - Current inventory of industrial and commercial land and buildings to assist in business expansion, retention and relocation. Wage and benefit information for employers.

Marketing materials - Developed materials and information

Annual Strategic Planning Session - Directors meet on annual basis to review mandates, examine internal and external environments affecting the JCEDC and plan objectives accordingly.

2020 Land Use Steering Committee - Represent the economic development component.Plan forwarded to Jefferson County Board.

The JCEDC acts as the focal point for guiding and coordinating economic development activities in Jefferson County and has continued to grow since its beginning in 1995.

WHEREAS, the Countryside Board of Trustees was authorized by Resolution No. 98-68, approved by the Jefferson County Board of Supervisors on November 12, 1998, to receive bids on a new van to replace a 1984 station wagon, and

WHEREAS, bids were received and opened by the Board of Trustees on December 1, 1998 with the following results:

WHEREAS, it is the recommendation of the Countryside Board of Trustees that the low bid of Smith Motors, Fort Atkinson, Wisconsin be accepted,

NOW, THEREFORE, BE IT RESOLVED that the recommendation of the Board of Trustees be and is hereby approved and they are authorized to enter into a contract with Smith Motors for one (1) 1999 Chevrolet Venture for a total cost without trade of $21,251.00 as soon as practicable.

Mrs. Smith read Resolution No. 98-77.

WHEREAS, the Department of Health and Family Services (DHFS) has proposed to amend the distribution of Intergovernmental Transfer Program (ITP) funds provision so that counties, rather than county nursing homes, be paid the funds claimed above budgeted levels. This proposal would mandate that these funds be spent only on COP, the Medicaid Home and Community Based Waiver Programs, or Family Care. This resolution encourages the Jefferson County Board of Supervisors to oppose amending the existing distribution provision.

NOW, THEREFORE, the Countryside Board of Trustees recommend adoption of the following resolution:

BE IT RESOLVED that the Jefferson County Board of Supervisors opposes amending the distribution provision of the Intergovernmental Transfer Program, and

BE IT FURTHER RESOLVED that the Jefferson County Board of Supervisors encourages the Governor to not alter the distribution provision of the Intergovernmental Transfer Program in his next biennial budget, and

BE IT FINALLY RESOLVED that the Jefferson County Clerk be directed to forward a copy of this resolution to the Governor of the State of Wisconsin, the Secretary of the Department of Administration, the Jefferson County Delegation of Legislators, and the Wisconsin Counties Association.

Mr. Maasz read Resolution No. 98-78.

WHEREAS, the Jefferson County Highway Committee was authorized by Resolution 97-67, passed by the Jefferson County Board of Supervisors on November 14, 1997, to receive bids on various equipment, and

WHEREAS, bids were solicited for one (1) new, 1999 model, 1-ton, crewcab truck with dump body, and such bids were received and opened on November 18, 1998, with the following results:

Mr. Maasz read Resolution No. 98-79.

WHEREAS, the Wisconsin County Highway Association has worked long and hard to prepare legislation to help limit accidents with our snowplows when they are in the act of winter maintenance, and

WHEREAS, a copy of that legislation, AB78, is included for your consideration,

NOW, THEREFORE, BE IT RESOLVED that the Jefferson County Board of Supervisors does hereby express its support for this legislation and directs the Clerk to mail a copy of this resolution to our State Legislators asking for their support on this important bill.

Mr. Maasz moved that Resolution No. 98-79 be adopted. Seconded and carried.

Mr. Hartwig read Ordinance No. 98-44.

The Jefferson County Board of Supervisors does ordain as follows:

SECTION 1. The Jefferson County Alarm Systems Ordinance, Ordinance No. 18, adopted April 21, 1981, is hereby amended as follows:

1. Section 18.03(10) is amended to read:

(10) The term "false alarm" means the activation of an alarm system through mechanical failure, malfunction, improper installation, or the negligence of the owner or lessee of an alarm system, or of his employees or agents or other undetermined cause. False alarm does not include alarms caused by tornadoes, other violent climatic conditions, or intermediate disruption of telephone circuits beyond the control of the alarm company and/or alarm owner/lessee.

2. Section 18.05 is amended by adding at the end:

"Direct dial alarm devices used by physically handicapped persons are specifically exempt from this section.

3. Section 18.09 is amended to read:

18.09 FEE FOR ANSWERING ALARMS. There is hereby imposed a fee for law enforcement response to any alarm resulting from the activation of an alarm system, except when law enforcement finds that an unauthorized person is on the premises, was seen on the premises immediately before the alarm was activated, or that there is fresh evidence of forcible entry or attempted forcible entry. There shall be no fee for the first two responses in any 12-month period. Thereafter, the alarm owner/lessee shall pay a fee of $25 for the third response in said 12-month period; $50 for the fourth response in said 12-month period; and $100 for the fifth and each successive response in the 12-month period. The fee is inapplicable when the alarm is caused by a tornado, other violent climatic conditions, or intermediate disruption of telephone circuits beyond the control of the alarm company and/or alarm user. This fee is imposed whether the Sheriff's Department receives the alarm by direct connection or through an intermediary such as an answering service or central station. If the Sheriff is notified of the date of the installation of a new alarm system, the fee imposed by this section is waived for a 90-day period from the date of installation. Failure to pay the fee within 30 days of receipt of the bill shall be grounds for immediate disconnect from the system.

4. Section 18.11 is amended to read as follows:

18.11 PENALTIES. Any person who violates any provision of this ordinance shall upon conviction thereof pay a forfeiture to the County of Jefferson of not less than $10 nor more than $300, along with statutory assessments and costs. The Sheriff's Department is authorized to issue citations for violations of this ordinance.

5. Section 18.12 shall be repealed and recreated to read:

18.12 PRIVATE REVIEW REQUIRED. The owner or operator of any premises for which the Sheriff's Department has received seven false alarms within any six-month period shall be required to have further alarms answered by private security forces at the expense of the alarm owner/lessee to determine whether or not any subsequent alarms are false alarms before the alarm is transmitted to the Jefferson County Sheriff's Department for response.

SECTION 2. Citation Ordinance No. 84-10, Section 3, as amended, is hereby amended to include in the schedule of cash deposits the following:

WHEREAS, the County Board, pursuant to ยง59.36, Wisconsin Statutes, establishes the amount of fees for services provided by the Coroner's office, and

WHEREAS, the Coroner has reviewed the current fees and compared them to fees in comparable counties and recommends the fees set forth below,

NOW, THEREFORE, BE IT RESOLVED that effective January 1, 1999, fees for services of the Jefferson County Coroner's office are hereby established as follows:

WHEREAS, the Jefferson County Board of Supervisors has heretofore been petitioned to amend the Jefferson County Zoning Ordinance, and

WHEREAS, Petition 2041A-98 was referred to the Jefferson County Planning and Zoning Committee for public hearing on September 17, 1998, and Petitions 2043A-98, 2045A-98, 2048A-98 and 2049A-98 were referred for public hearing on November 18, 1998, and

WHEREAS, the proposed amendments have been given due consideration by the Board of Supervisors in open session,

NOW, THEREFORE, BE IT ORDAINED that the Jefferson County Board of Supervisors does amend the Zoning Ordinance of Jefferson County (and accompanying zoning maps) as follows:

FROM AGRICULTURAL A-1 TO A-3, RURAL RESIDENTIAL

Create a lot of no more than 2.2 acres on Hill Road from part of Parcel 08-16-15-31 (36.87 Acres) in the Town of Ixonia. This action is conditioned upon receipt by Zoning of a soil test showing sites for installation of both initial and replacement private sewage systems, and upon approval and recording of a final certified survey map. Create two, 1.3 acre lots on Klug Lane from part of Parcel 08-13-11-13 (37.769 Acres) in the Town of Waterloo. Rezoning in these non-prime agricultural soils is conditioned upon receipt by Zoning of a soil test for each lot showing sites for installation of both initial and replacement private sewage systems, and upon approval and recording of a final certified survey map. Rezone to create a 1.25 acre lot around existing buildings at N9213 Ash Road in the Town of Watertown from part of Parcel 08-15-12-22-001 (27.777 Acres). Rezoning is conditioned upon approval and recording of a final certified survey map showing a minimum of 20 feet between buildings and proposed side and rear lot lines. (2045A-98 - Daniel Lapin)

Rezone 6.8 acres with existing home and farm buildings on Parcel 06-16-22-44 (36.56 Acres). The site is at N3363 CTH E in the Town of Sullivan. Rezoning is conditioned upon approval and recording of a final certified survey map. (2048A-98 - John Northey)

Create a 5.5 acre rural residential building site on CTH A, Town of Milford, from part of Parcel 08-14-24-34 (46.052 Acres). This rezoning, in primarily non-prime agricultural soils, is conditioned upon receipt by Zoning of a soil test showing sites for installation of both initial and replacement private sewage systems, and upon approval and recording of a final certified survey map. Pursuant to Section 59.18 of the Wisconsin Statutes and County Board Resolution No. 12 approved April 21, 1970, I hereby reappoint L. H. Holley, Waterloo, Wisconsin, as a member of the Sheriff's Civil Service Commission. This appointment is for a five-year term and will expire January 1, 2004. I respectfully request confirmation of this appointment.

I respectfully request confirmation of this appointment.
