MINUTES

CITY OF JEFFERSON

PLAN COMMISSION

WEDNESDAY, MAY 14, 2003

The meeting was called to order. Plan Commission members present were: Adams, Beyer, Brawders, Bare, and Ludwig. Absent were: Brandel and Nash. Also present were City Attorney Brantmeier, and City Administrator Schornack.

PUBLIC PARTICIPATION

There was no public participation.

APPROVAL OF PRELIMINARY CERTIFIED SURVEY MAP SUBMITTED BY JOE SZWEC FOR A LOT ON EAST PUERNER STREET

Mr. Joe Szwec appeared before the commission regarding the survey approval of his lot on East Puerner Street. Bare stated his concern for a drainage easement, if further development occurs around Szwec’s lot. City Engineer Ludwig said that a drainage and utility easement could be shown. It was suggested to label a 10’ drainage and utility easement on the east side of the Szwec lot and a complimentary 10’ easement, in the future, from the adjacent lot to render a 20’ easement.

It was moved by Adams and seconded by Bare to recommend the preliminary certified survey map, with 10’ easement, for the Joe Szwec lot on E. Puerner Street.

REVIEW AND RECOMMENDATION ON PROPOSED ORDINANCE #3-03 RELATING TO STANDARDS FOR LARGE RETAIL BUILDINGS

Tim Bare addressed No.3 of Ordinance #3-03. It was agreed to recommend removal of the verbiage “and are within one hundred (100) feet of”.

It was also decided that the lighting issues should be clarified when this ordinance goes before the Council.

Beyer stated that we loose out on false promises when granting an occupancy permit. Attorney Brantmeier said that the Plan Commission has no statutory authority over occupancy.

Bare expressed his concern over impact fees in #20 of Ordinance #3-03. It was suggested to include as many impact fees as may legally apply into the developers agreement. City Attorney Brantmeier will look into the extent of developers fees and inform the council.

The motion was made by Adams and seconded by Bare to recommend Proposed Ordinance #3-03 to the City Council relating to standards for large retail buildings and to delete the wording “and are within one hundred (100) feet of” as above. Motion carried unanimously on voice vote.

It was moved by Bare and seconded by Beyer to approve the minutes of April 23, 2003. Motion carried unanimously.
