Jefferson County Treasurer

County Clerk Geyer reported that a notice of injury and claim for damages was filed by attorneys for Taylor Kelley of Fort Atkinson, Wisconsin, for injuries received on a slide at Fort Fest June 14, 1996.

The claim was ordered received, placed on file, and referred to the Corporation Counsel.

The Clerk reported that a claim has been filed by Larry D. Rasmussen of Waterloo, Wisconsin, against the County and numerous employees alleging damages for negligent or intentional wrongdoing in connection with the adjudication of his divorce case.

The claim was ordered received, placed on file, and referred to the Corporation Counsel.

The Clerk read a letter from Governor Tommy G. Thompson congratulating Jefferson County for meeting the caseload performance criteria established by the Department of Workforce Development and as a result earning the right of first selection to be a Wisconsin Works (W-2) administrative agency.

The letter was ordered received and placed on file.

The County Clerk read a letter from the Jefferson County Sheriff's Department reporting on the results of the 1996 Sheriff's Sale which brought a total revenue of $419.

The letter was ordered received and placed on file.

The Clerk read a letter addressed to Dr. Gerald McGowan, Chairman of the Jefferson County Library Council, from Carolyn Heidemann, Lake Mills, Wisconsin, asking that when Ms. Heidemann's term on the Library Council ends on December 31, 1996, she not be reappointed to a third term.

The letter was ordered received and placed on file.

The Clerk read a notice of public hearing from the Jefferson County Planning and Zoning Committee, said hearing to be held on Tuesday, October 22, 1996 at the Jefferson County Courthouse. The subject of the hearing is a recently filed petition asking the Jefferson County Board to enact an ordinance which would bring about a moratorium on residential and commercial development in rural areas of Jefferson County until the Jefferson County Plan Steering Committee completes the Jefferson County 2020 Plan.

The County Clerk read a Notice of Public Hearing from the Zoning Committee. As a Special Order of Business Ms. Darla Hium of the Wisconsin Counties Association reported on the organization and goals of the Wisconsin County Mutual Insurance Corp. She also presented Jefferson County with a dividend check in the amount of $48,627.

The annual report of the University Extension Office was presented by Ken Bolton, Dairy/Livestock Agent/Office Chair, along with Mary Gruenewald, Family Living Agent, Steve Grabow, Community Development Agent, and Margaret O'Brien, 4-H Youth Development Agent.

TO THE HONORABLE JEFFERSON COUNTY BOARD OF SUPERVISORS:

MEMBERS OF THE BOARD:

Pursuant to Wisconsin Statutes, Section 59.033(5) and County Board Resolution No. 12, April 21, 1970, the recommended 1997 Administrator's Budget is submitted for your review, consideration and action. The accompanying proposed budget has been reviewed and approved by the County Board Budget Committee.

The preparation of this Budget document represents the combined work of the County Board Budget Committee, County Clerk, County Administrator, and their staffs.

This recommended Budget is conservative, and while it does not provide funds for all programs requested, and the revenues expected from State and Federal sources are unclear at the time of printing, I feel it represents the best interests of Jefferson County. However, it is also a responsible and realistic budget which should not need further supplementation during the year.

I will be happy to discuss with you any of my recommendations and would encourage your hard review of this Budget before final passage in November.

COUNTY ADMINISTRATOR'S RECOMMENDATION IN SUMMARY

INTRODUCTION

Pursuant to Wisconsin Statutes 59.033(5) and County Board Resolution No. 12, approved April 21, 1970, the recommended tentative Jefferson County 1997 Annual Budget is submitted to the County Board of Supervisors for their review, consideration, and action.

The tentative 1997 tax rate is recommended at 3.9930 per $1,000 valuation. This compares to 4.2655 in 1996 or a decrease of .2725.

It should be noted that there was an increase of $302,439,500 in equalized value of County property on which the tax rate is based. The County's overall total equalized value was reduced this year by $79,724,755 under the Tax Incremental Financing Program resulting in an impact of $318,340 on the County Budget.

EXCEPTIONS

There are exceptions, limitations and judgments that the County Board should be aware of concerning the tentative proposed budget. Certain assumptions and judgments must be made at the time of preparation and are based upon the best information available. Such areas are as follows:

  • 1. Labor negotiations: Labor contracts are in place with all labor units through 1997. Negotiations will commence in the last quarter of 1997 for 1998.

    2. State Special Charges and State Shared Revenue are estimated based on current information and may change when final figures are received from the Wisconsin Department of Revenue. State Shared Revenue has been budgeted at $3,494,220, an increase of $251,420 from 1996.

    3. Revenue for programs with mandated levels of service may or may not be as firm as indicated. However, as in the past, the Budget Committee has been conservative in their estimates. The reduction or enhancement in State and Federal funds is not fully appreciated at this time and could mean some alteration of programs in 1997.

    4. When comparisons are made with other counties, the level and types of service provided should be taken into consideration, i.e. Countryside Home, Human Services, Highway and Sheriff's Department.

  • 1997 BUDGET PROCESS

    The budget process began on August 1, 1996 with a meeting of all department heads. They generally had two weeks to prepare and submit their 1997 budget requests for the County Administrator's review and recommendations. Larger departments were granted an extension to allow County Board Committee or Board participation. Conferences were held with department heads on an individual basis and Committee and Board meetings were attended to better understand requests and recommendations.

    The Budget Committee has now met on the following dates to formulate the tentative 1997 Budget:

    September 11, 12, 13, 1996 - Budget Committee meetings with individual departments. September 20, 1996 to make final adjustments to the 1997 County Budget.

    At this point the recommendations of the Budget Committee became the tentative 1997 County Budget. The proposed 1997 County Budget will be presented to the County Board on October 8, 1996 and will lie over until the November session. A public hearing is scheduled for November 13, 1996 at 7:30 p.m. so that the citizens of Jefferson County may express their interest, opinions and help as the County Board continues to develop and formulate the 1997 Budget.

    COUNTY SALES TAX

    By the adoption of Ordinance No. 90-09 on August 14, 1990, the Jefferson County Board of Supervisors approved the creation of a County sales tax effective April 1, 1991. Monies collected have been used to retire the debt of the Jail/Courthouse building project. Excess revenue is used to lower the levy as required by law.

    On November 16, 1995, the Jefferson County Board of Supervisors approved Resolution No. 95-47 to transfer $5,351,877 from the General Fund to create an escrow account for the purpose of providing payment of the 1990 Notes and 1991 Notes maturing in the years 1997 and thereafter. Jefferson County will be debt free in 1997. It is estimated that Jefferson County will receive $2,850,000 in sales tax revenue. The Budget Committee has allocated this amount to be applied to the 1997 Budget. The proposed tax rate as presented is 3.9929 per $1000 of equalized value. If the sales tax were to be eliminated, the rate would be 4.9787, an increase of .9858 per $1000 of equalized value or about 25%.

    By law, the County is required to have a levy no higher than 4.6695 per $1000 of equalized value. This would require the proposed budget to be cut by .3092 per $1000 equalized value and require approximately $1,000,000 to be eliminated from capital spending. As presented, this proposed budget is .6766 per $1000 of equalized value below the required spending cap.

    WISCONSIN WORKS (W-2)

    Wisconsin Works (W-2) is the first major change in the welfare system since its inception in the 1930s. In Wisconsin, counties have played the major role in determining eligibility and providing social service for welfare recipients. Employment and training programs have been conducted in joint efforts between counties and public sector employment agencies such as Job Service.

    The Human Services Board and Department are planning to operate Wisconsin Works in Jefferson County. Work has been underway during most of 1995 and 1996 to plan this program and to organize and change the Income Maintenance Section of the Department in order to successfully operate W-2. A primary concern in planning to continue to operate the welfare system has been a concern for good coordination of the many services which many welfare recipients will need in order to be successful in the workplace. Most of these persons are young single women who have little work experience, inadequate education and quite often have had lives marked with many personal and family problems. We recognize that in order to require people such as these obtain and hold employment we will need to use many resources which the Department has in order to assist them. These include parenting assistance, mental health and chemical dependency services, day care and training in daily living skills. This coordination of services has been the purpose and function of the Jefferson County Human Services Department since it was created in the 1980s.

    As we enter into implementing W-2 we will need to be fiscally prudent. Current funding allocations from the State appear to be adequate to fund W-2 as it begins in the last quarter of 1997 and through 1998. County funding for this program is not part of the 1997 Budget and is not anticipated in the 1998 Budget. In order to monitor W-2 overall, regular program and fiscal reports will be given to the Human Services Board. We anticipate being successful in operating W-2 and look to working cooperatively with community employers and other service providers as we undertake this new challenge.

    JEFFERSON COUNTY PLAN 2020

    In 1996 Jefferson County addressed the management growth within the County. The activities of the Steering Committee have been well documented. This project was estimated to take two years to complete. In 1996, $200,000 was budgeted. An additional $70,000 has been provided by the Budget Committee to complete this plan and is included in the 1997 Zoning Department's budget.

    MISCELLANEOUS

    As mentioned last year, L. S. Power was selected to build a cogenerating power plant in Whitewater and located in Jefferson County. The construction time table was set at nineteen months with a completion date of June 1, 1997.

    The Budget Committee has included funding in the amount of $67,000 for the continued support of the Economic Development Corporation in Jefferson County.

    The Budget Committee has approved $108,000 for the continuing construction of the Glacial River Trail. The first phase opened in September, 1996 and is completed as far as Koshkonong Lake Road. The second phase will continue from that point to the Rock County line, a distance of two miles.

    The 1997 allocation of funds for Child-Out-Of-Home placements at Human Services has been reduced by approximately $200,000 from 1996 utilization levels. This has been done for two reasons: 1) We are hopeful in projecting that the service cost increases which occurred during late 1995 and 1996 have been an occurrence that has finally slowed, and in fact reduced at this point in time; 2) The Human Services Department is hopeful that expansion of their ability to supervise serious juvenile offenders in the community will prevent placements that otherwise might have occurred. Additionally, the Human Services Department in cooperation with many other partners, including schools, U.W. Extension, Community Service providers and members of the Court system are undertaking a joint planning process to reduce and prevent juvenile crime. Training, the creation of a Community Delinquency Prevention Board and seeking additional Federal funding are steps which will also help this effort.

    The air conditioning of Countryside was completed in 1996! Fine tuning, balancing and general cleanup continued through the cooling season but should wind up this year. The project has taken four years of planning and actual construction. No funds are required in 1997.

    The Budget Committee has included $102,000 for capital improvements at Jefferson County Fair Park. The Jackson Street expansion, new entry gates and fencing are major projects to be completed in 1997.

    CONTINGENCY FUND

    A $325,000 appropriation is requested for 1997. This is the same amount that was approved in the 1996 Budget.

    WHEREAS, the Jefferson County Board adopted Resolution No. 75 on September 15, 1970, modifying the County Trunk Highway System, which resolution has been amended from time to time and approved by the State Department of Transportation, and

    WHEREAS, it is desirable to relocate that portion of County Trunk Highway "P" currently routed over Marietta Avenue to County Trunk Highway "F" in Sections 21 and 22, Town of Ixonia, (Town 8 North, Range 16 East) over Town of Ixonia road Elmwood Avenue from its intersection with County Trunk Highway "P" to County Trunk Highway "F",

    NOW, THEREFORE, BE IT RESOLVED that Resolution No. 75, adopted September 15, 1970, and as amended thereafter, is hereby amended to route County Trunk Highway "P" in Sections 21 and 22, Town of Ixonia, over the town road right of way described as follows: Commencing at the intersection of current County Trunk Highway "P" with right of way dedicated to the public for highway purposes as shown on Certified Survey Map No. 3336 recorded in Volume 14, Page 268, Certified Survey Maps, as Document No. 962090, thence Southeasterly along said right of way to the Northwest end of the extension of Elmwood Avenue as shown on Certified Survey Map No. 3273 recorded in Volume 14 of Certified Surveys at Page 133 as Document No. 957244; thence along Elmwood Avenue to its intersection in Section 22 with County Trunk Highway "F".

    BE IT FURTHER RESOLVED that the portion of current County Trunk Highway "P" in Sections 21 and 22, Town of Ixonia, Town 8 North, Range 16 East, shall be discontinued from its terminus at County Trunk Highway "F", thence Westerly along Marietta Avenue, thence Southerly and Westerly to the point of intersection with the above described right of way as shown on Certified Survey Map 3336, Volume 14 of Certified Survey Maps, Page 268.

    BE IT FURTHER RESOLVED that this resolution shall operate as a transfer of maintenance jurisdiction from the Town of Ixonia to Jefferson County for that portion of road above described over which County Trunk Highway "P" is hereby relocated (Elmwood Avenue), and a transfer of maintenance jurisdiction from the County to the Town of Ixonia for that portion of County Trunk Highway "P" discontinued (Marietta Avenue) and that this resolution and transfer of jurisdiction between the County and Town shall be effective upon certification of the Jefferson County Highway Commissioner that Elmwood Avenue has been constructed to County Highway minimum design standards, approval by the Town of Ixonia, and approval by the Wisconsin Department of Transportation.

  • Note: The discontinued segment of County Trunk Highway "P" shall revert to town road status pursuant to Section 80.40, Stats. Pursuant to Jefferson County Traffic Code Ordinance No. 300, Section 2(1), county trunk highways "shall be arterial highways and all traffic entering or crossing county trunk highways from town roads . . . shall stop." Therefore, traffic on County Trunk Highway "P" will not stop between the westerly end of the rerouted portion and its intersection with County Trunk Highway "F". Traffic entering or crossing County Trunk Highway "P" from the discontinued segment of County Trunk Highway "P" on the north and east, and from the public right of way to the south as shown on Certified Survey Map 3336 shall stop.

    NOW, THEREFORE, BE IT RESOLVED that the Chairman of the Jefferson County Land Conservation Committee is authorized, in accordance with Chapter 92, Wisconsin Statutes, to execute the mutual agreement for cooperation between the Committee, State of Wisconsin and the United States Department of Agriculture.

    (2) To any citation issued for disorderly conduct, the officer shall review the provisions of s. 973.055(1) to determine if a domestic abuse assessment is applicable, and, if so, add the statutory amount for such assessment to the cash deposit set forth herein.

    (3) Any amendment to s. 165.87, Wis. The County Board Chairperson, the Vice-chairpersons and such other Board members as may be designated by the Chairperson, shall be entitled to per diem and mileage for attending such meetings and conferences, all subject to the regular rules of the County Board pertaining to per diem, mileage and expenses. Board members authorized by the Chairperson to attend meetings and conferences shall notify the County Administrator not less than 72 hours in advance of said meeting or conference.

    The County Board of Supervisors of Jefferson County does hereby ordain that Section 3.03(11)(f) of the County Board Rules is amended as follows:

    (f) Candidates receiving a majority vote of the number of County Board members present shall be declared elected. Should no one receive a majority vote the person receiving the lowest number of votes shall be dropped from the ballot. The Clerk shall again call the roll and one ballot shall be delivered to each Board member present, repeating if necessary, until all vacancies are filled. If the number of candidates receiving a majority vote of County Board members present exceeds the number of positions to be filled, any person not receiving a majority vote shall be dropped from the ballot. The Clerk shall again call the roll with only those receiving a majority vote remaining on the ballot. The person receiving the lowest number of votes shall be dropped from the ballot each succeeding ballot until the number of candidates receiving a majority vote equals the number of positions to be filled.

     

    (Explanatory note: This addresses the 1996 election of the Highway Committee where six persons received a majority vote and others received less than majority, and specifies a procedure to resolve the issue.)

    The County Board of Supervisors of Jefferson County does hereby ordain that Section 3.05(2)(j) of the County Board Rules is repealed and recreated as follows:

    (j) JUDICIARY COMMITTEE -- Three members: County Board Chairperson, First Vice-chairperson, and Second Vice-chairperson. This committee shall meet with the Circuit Court Judges twice a year, and as called, to discuss common goals and concerns within the Jefferson County Circuit Court system. The committee shall work with the Courts to implement such goals.

    The Jefferson County Planning and Zoning Committee, having considered petitions to amend the Zoning Ordinance of Jefferson County, filed for public hearing August 15, 1996 and September 19, 1996 as required by law pursuant to Wisconsin Statutes, notice thereof having been given, and being duly advised of the wishes of the town boards and persons in the areas affected, hereby makes the following recommendations:

    APPROVAL OF PETITIONS 779A-84-96M AND 1823A-96

    DENIAL OF PETITIONS 1812A-96 AND 1819A-96

    Petition 1812A-96 was filed by John Kannard to rezone eight acres along CTH CI in the Town of Sullivan in order to create four, two acre lots. This is recommended for denial because the site is outside any urban service area and has soils that have demonstrated crop production. The Committee noted that modern technologies in soil amendment and nutrient management along with improved conservation tillage practices have greatly improved productivity potential of soils previously considered non-productive.

    The Committee also recommends denial of Petition 1819A-96. This was a request by John Kannard to rezone approximately 31 acres to create three new rural residential building sites. This recommendation is also based upon past and recent cropping history and upon current crop production on site.

    NOW, THEREFORE, BE IT ORDAINED that the Jefferson County Board of Supervisors does amend the Zoning Ordinance of Jefferson County (and accompanying zoning maps) as follows:

    FROM AGRICULTURAL A-1 TO A-3, RURAL RESIDENTIAL

    Create a lot of 3.16 acres and one of 2.78 acres along Stoney Creek Road in wooded, non-prime ag soils. Parcels 07-13-05-32 (4.336 Acres) and 07-13-06-41 (40 Acres) are in the Town of Lake Mills. This action is conditioned upon receipt by the Zoning Department of a soil test for each lot showing sites for installation of both initial and replacement private sewage systems and upon approval and recording of a final certified survey map.
