Jefferson County Treasurer

Deputy County Clerk Frank read a letter addressed to the County Clerk from Sheriff Orval Quamme, in which the Sheriff submitted his resignation effective Friday, November 1, 1996, and for the remainder of the present term. He indicated he would remain a candidate for the 1997-1998 term for the Office of Sheriff and that upon election he will take the oath of office and serve the 1997-98 term.

The letter was ordered received and placed on file.

Deputy Clerk Frank read a letter addressed to the County Clerk from the Wisconsin Governor's Office advising that Governor Thompson has received notification from Sheriff Quamme of his resignation effective November 1, 1996, and also advising that the Governor does not wish to exercise his authority to appoint an interim sheriff per Wis. Stat. 17.21(1).

The letter was ordered received and placed on file.

The Deputy Clerk read a letter from Town of Farmington Attorney, Andrew R. Griggs, addressed to Mayor Arnold Brawders of the City of Jefferson, in support of maintaining the Rock River dam in the City of Jefferson, and enclosing a resolution from the Town of Farmington opposing the removal of the dam.

The communication was ordered received and placed on file.

The Deputy County Clerk read a Notice of Circumstances of Claim from the attorney for Gerald Marquardt, 114 Stimpson Street, #18, Watertown, Wisconsin. alleging damages as a result of an altercation with law enforcement officers at the Jefferson County Courthouse on the 28th day of June, 1996.

The claim was referred to the Corporation Counsel.

The County Clerk read a Notice of Public Hearing from the Zoning Committee. Petitions for Zoning changes from the following persons are on the hearing agenda for Tuesday, November 19, 1996 at 7:00 p.m.: John Simon, Town of Milford; William Sheetz, Town of Jefferson; Leroy H. Mrs. Turner moved that the minutes of the special meetings of September 23 and September 27, 1996, and the regular October 8, 1996 meeting be approved as corrected. Seconded and carried.

Mr. Kisow moved that the proposed 1997 Jefferson County Budget be taken from the table. Seconded and carried.

County Administrator Willard Hausen gave a detailed explanation of the proposed budget.

Mr. Kisow moved that the proposed 1997 Budget be laid on the table. Seconded and carried.

Mr. Buchanan read Resolution No. 96-45.

WHEREAS, on September 16, 1996, Jefferson County received a notice of claim for damages from the attorney for Taylor Kelley who allegedly was injured on or about June 14, 1996 in an accident which took place at the Fort Fest celebration in the City of Fort Atkinson,

NOW, THEREFORE, BE IT RESOLVED that the Jefferson County Board of Supervisors hereby disallows said claim and directs the Corporation Counsel to give notice of said disallowance.

Mr. Buchanan moved that Resolution No. 96-45 be adopted. Seconded and carried.

Mr. Kisow read Resolution No. 96-46.

WHEREAS, Jefferson County currently has insufficient secure storage space for items seized by the Sheriff's Department in the course of performing its duties, and

WHEREAS, a secure facility is currently for sale in Jefferson County approximately six miles south of Jefferson, and

WHEREAS, such property may be purchased for an advantageous price, and used by a number of County departments,

NOW, THEREFORE, BE IT RESOLVED that the County Administrator is authorized to execute, on behalf of Jefferson County, the contract for purchase of property located at N2291 CTH N, for the sum of $264,000 on the terms and conditions submitted to the Board herewith, and

BE IT FURTHER RESOLVED that the sum of $312,000 is hereby transferred from the Undesignated General Fund, Account No. 100-00-34290, to the Storage Facility Account No. 100-20-52125 to provide for purchase, services in connection with the purchase including an environmental audit, interior painting and 1997 unbudgeted operation expenses.

BE IT FURTHER RESOLVED that as the sole user, the Sheriff's Department shall be responsible for the operational costs initially, and in the future the Building and Insurance Committee shall be authorized to apportion space in the facility to other departments and allocate a share of the operational costs to the using departments.

    THE COUNTY BOARD OF SUPERVISORS OF THE COUNTY OF JEFFERSON, STATE OF WISCONSIN, DO ORDAIN AS FOLLOWS:

    Section 2 of the County Traffic Ordinance (PROHIBITED STOPPING IN CERTAIN SPECIFIED AREAS ON COUNTY TRUNK HIGHWAYS AND ELSEWHERE.) is amended by adding the following:

  • On the east and west sides of County Trunk Highway "F" right of way from a point 200 feet south of the intersection of County Trunk Highway "F" and Marietta Avenue in the Town of Ixonia, to a point 200 feet north of the intersection with Marietta Avenue.

    Along the west side of County Trunk Highway "Q" from a point 450 feet south of the centerline of County Trunk Highway "B", and extending southerly for a distance of 340 feet.

    Along the east side of County Trunk Highway "Q" from a point 1580 feet south of the centerline of County Trunk Highway "B", and extending northerly for a distance of 830 feet.

    On the north and south sides of County Trunk Highway "V" right of way from the centerline of State Trunk Highway "89" and extending easterly to County Trunk Highway "A".

  • Section 4 of the County Traffic Ordinance (SPEED ZONES ON COUNTY TRUNK HIGHWAYS) is amended by adding the following:

    COUNTY TRUNK HIGHWAY "A", TOWN OF OAKLAND, JEFFERSON COUNTY

  • Thirty-five miles per hour for all vehicles from the centerline of U.S.H. 12 northerly to a point 1.05 miles north of U.S.H. 12.
  • COUNTY TRUNK HIGHWAY "A", TOWN OF OAKLAND, JEFFERSON COUNTY

  • Forty-five miles per hour for all vehicles from a point 1.05 miles north of the centerline of U.S.H. 12 northerly to U.S.H. 18.
  • This ordinance amendment shall be effective upon passage, publication and erection of official signs.

  • NOTE: The reduction to 35 m.p.h. for the portion of C.T.H. "A" immediately north of U.S.H. 12 has been approved (as required) by WISDOT.
  • Mr. Maasz moved that Ordinance No. 96-23 be adopted. Seconded and carried by the following roll call:

    WHEREAS, from time to time it is necessary for Jefferson County to house out-of-County prisoners for other jurisdictions, and

    WHEREAS, the $55.00 charged per day is now inadequate for the purpose for which it was intended, and

    WHEREAS, based on discussion of the Law Enforcement Committee, it is their recommendation that this charge now be increased to $60.00 per day to better reflect actual cost,

    NOW, THEREFORE, BE IT RESOLVED that the charge for out-of-County prisoners is hereby increased to $60.00 per day upon adoption of this resolution.

    Mr. Buchanan read Resolution No. 96-48.

    WHEREAS, the Jefferson County Board last established a pay rate for the Jefferson County Undersheriff in Resolution No. 80-39, dated July 8, 1980, which resolution provides in part that the Undersheriff shall be compensated at the rate paid part-time deputies when employed to transport prisoners, and

    WHEREAS, no provision was made for compensation of the Undersheriff when acting as a bailiff or when the office of Sheriff is vacant, as is currently the case,

    NOW, THEREFORE, BE IT RESOLVED that Resolution No. 80-39 is amended to provide that the Undersheriff shall be compensated at the rate paid part-time deputies when transporting prisoners, acting as court bailiff, or for hours actually worked during a vacancy in the office of Sheriff.

    TO THE HONORABLE MEMBERS OF THE JEFFERSON COUNTY BOARD OF SUPERVISORS

    The Jefferson County Planning and Zoning Committee, having considered petitions to amend the Zoning Ordinance of Jefferson County, filed for public hearing October 17, 1996 as required by law pursuant to Wisconsin Statutes, notice thereof having been given, and being duly advised of the wishes of the town boards and persons in the areas affected, hereby makes the following recommendations:

    APPROVAL OF PETITIONS 1825A-96, 1826A-96, 1827A-96,

    1829A-96, 1830A-96 and 1832A-96

    DENIAL OF PETITIONS 1632A-95-96M, 1763A-96M,

    1813A-96, 1828A-96M AND 1831A-96

    Petition 1632A-95-96M was filed by Wayne Hensler to rezone 3.4 acres along CTH A in the Town of Lake Mills. This request is recommended for denial because the site is made up of mainly prime agricultural soils with a cropping history.

    Likewise, Petition 1763A-96M is recommended for denial due to the prevalence of prime agricultural soils on site. In this petition, Alois Hoffmann had requested rezoning of 1.24 acres along Hillside Road in the Town of Concord.

    Leslie Fredrick proposed creating a 1.25 acre lot around an existing home at N5468 Hillside Drive in the Town of Concord with Petition 1813A-96. This request is recommended for denial because of the prevalence of prime agricultural soils on the entire parcel in question.

    Petition 1828A-96 was filed by Frank Lenz for property on Stoney Creek Road in the Town of Lake Mills. This request for a 4 acre lot is recommended for denial in part due to town board denial, and because the site is comprised of Class III soil types.

    Kent MacLaughlin's request to create two new residential building sites along Island Road in the Town of Waterloo is also recommended for denial due to the prevalence of prime agricultural soils. This was filed as Petition 1831A-96.

    WHEREAS, the Jefferson County Board of Supervisors has heretofore been petitioned to amend the Jefferson County Zoning Ordinance, and

    WHEREAS, Petitions 1825A-96, 1826A-96, 1827A-96, 1829A-96, 1830A-96 and 1832A-96 have been referred to the Jefferson County Planning and Zoning Committee for public hearing on October 17, 1996, and

    WHEREAS, the proposed amendments have been given due consideration by the Board of Supervisors in open session,

    NOW, THEREFORE, BE IT ORDAINED that the Jefferson County Board of Supervisors does amend the Zoning Ordinance of Jefferson County (and accompanying zoning maps) as follows:

    FROM AGRICULTURAL A-1 TO A-3, RURAL RESIDENTIAL

    Rezone 1.65 acres on CTH Y for a new residential building site. Parcel 07-15-19-32 (26.54 Acres) is in the Town of Farmington. This action is conditioned upon receipt by Zoning of a soil test showing sites for installation of both initial and replacement private sewage systems, and upon approval and recording of a final certified survey map.     Modify the original request and allow creation of one 3 acre residential building site, proposed Lot 1, on STH 26 in the Town of Koshkonong from Parcel 05-14-30-21-002 (12.79 Acres). Rezoning is conditioned upon receipt by the Zoning Office of a soil test showing sites for installation of both initial and replacement private sewage systems, and upon approval and recording of a final certified survey map for the property.     Rezone part of Parcel 05-14-14-23-001 (14.180 Acres) in order to create a 1.7 acre lot, a 2 acre lot at N1513 USH 12, and a 2.3 acre lot, all in the Town of Koshkonong. This action is conditioned upon receipt by Zoning of a soil test for each of the vacant lots showing sites for installation of both initial and replacement private sewage systems, and for approval and recording of a final certified survey map.     Rezone 1.3 acres of Parcel 07-13-32-12-001 (3.13 Acres) near W9095 London Road in the Town of Lake Mills. The property is owned by RBC Properties Inc. Rezoning is conditioned upon receipt by the Zoning Department of soil tests showing sites for installation of both initial and replacement private sewage systems, and for approval and recording of a final certified survey map.     Rezone to create two 2.1 acre lots along Springer Road from part of Parcel 08-13-26-21 (32.970 Acres) in the Town of Waterloo. This action is conditioned upon receipt by Zoning of a soil test for each lot showing sites for installation of both initial and replacement private sewage systems, and for approval and recording of a final certified survey map.     Create a 4.1 acre residential building site from part of Parcel 08-13-23-33-001 (7.3 Acres) on Conservation Lane in the Town of Waterloo. Rezoning is conditioned upon receipt by the Zoning Office of a soil test showing sites for installation of both initial and replacement private sewage systems, and upon approval and recording of a final certified survey map.     Mrs. Smith moved that the Board convene in closed session pursuant to s. 19.85(1)(g) to confer with legal counsel regarding pending litigation in the case of Jefferson County vs. Butters-Fetting, et al. Seconded and carried by the following roll call:

    WHEREAS, Jefferson County is involved in litigation to recover funds expended related to an oil spill at Countryside Home in 1990, and

    WHEREAS, offers to settle such litigation may be made during the course of litigation at a time when it is not possible to convene a County Board meeting for the purpose of entertaining such offer, and

    WHEREAS, the judge presiding in the matter has requested the County Board authorize a committee thereof to act upon settlement offers,

    NOW, THEREFORE, BE IT RESOLVED that the Building and Insurance Committee be delegated the authority to accept an offer to settle said litigation, if such settlement is, in the judgment of the Committee, in the best interest of the County at that time.

Watertown, Johnson Creek, Wisconsin to complete the term of Carolyn Heidemann, resigned from the Jefferson County Library Council that will expire on December 31, 1996.
