County Clerk Geyer read a letter addressed to the County Board from Susan Klausch, in which Ms. Klausch expressed her approval of having Planned Parenthood in Jefferson County.

The letter was ordered received and placed on file.

The County Clerk read a Notice of Public Hearing from the Zoning Committee. Petitions for Zoning changes from the following persons are on the hearing agenda for Thursday, December 19, 1996 at 7:00 p.m.: Donald and Vera Belle Flood, Town of Milford; Robert and Carol Haas, Town of Farmington; Jeanette Latterell, Town of Farmington; Don Reese, Town of Farmington; G. Dixon Telfer, Town of Hebron; G. As a Special Order of Business retiring District Attorney Linda Larson addressed the Board.

Mr. Buchanan read Resolution No. 96-59.

WHEREAS, on September 3, 1996, Jefferson County received a notice of claim for damages in the amount of $50,000 from the attorney for the Estate of Jack R. Syvertson and his father, Ronald Syvertson, as a result of the death of Jack R. Syvertson from an acute asthmatic attack on May 15, 1996, while he was being held in the Jefferson County Jail,

NOW, THEREFORE, BE IT RESOLVED that the Jefferson County Board of Supervisors hereby disallows said claim and directs the Corporation Counsel to give notice of said disallowance.

Mr. Buchanan moved that Resolution No. 96-59 be adopted. Seconded and carried.

Mr. Maasz read the following report:

HIGHWAY COMMITTEE REPORT

REGARDING CITY OF JEFFERSON BRIDGE PROJECT

For several years the City of Jefferson has been faced with the issue of replacing its North Street bridge. That bridge is now located two blocks southwest of the Jefferson County Highway Department, but, due to its condition, is used at an absolute minimum by the Department vehicles. Within the past year the City has determined to relocate the North Street bridge to Puerner Street which will pass through the far north side of Jefferson County Highway Department property when constructed.

During the City's siting process over the years, the Jefferson County Board has offered by resolution to dedicate right of way through the Fairgrounds for extension of Jackson Street from Racine Street to Hyer Drive on the condition that the City locate the bridge at the Puerner Street site. By Resolution 93-26, the County Board offered the City specific right of way through the north side of the Highway Department grounds to accommodate the Puerner Street location as envisioned at that time.

The original street right of way proposed in Resolution 93-26 has been modified by the City to accommodate concerns of City residents and the Highway Committee related to shifting the bridge to the south. As a result, the right of way the City needs for the current proposed alignment (Parcel "A") varies somewhat from that set forth in Resolution 93-26.

The right of way to be transferred, Parcel "A", is 1.7 acres, which appraises at $23,200. The City proposes transfer by the County in return for waiver of approximately $29,000 in special assessments.

As part of the process of negotiating transfer of the modified right of way, the City has offered to purchase 2.52 acres of Highway Department land (Parcel "B") lying north of proposed Puerner Street which would be separated from the balance of the Highway Department grounds. The Highway Committee believes that it is reasonable to transfer said lands to the City at the appraised price of $13,643 per acre for a total of $34,380.

The County also owns 1.85 acres of wetlands (Parcel "C") on the north side of the future street, which, for all practical purposes, has no value to the County. The Committee believes it is in the County's best interest to trade that wetland area to the City for a .222 acre triangular parcel (Parcel "D") lying south of the proposed new street and immediately adjacent to the Department's north property line which the City has acquired from another property owner as part of right of way acquisition for this project. The City will waive the special assessments for this parcel which are approximately $15,000.

Additional items tentatively agreed to by the parties are: (a) fencing along the north boundary of the Highway Department property, including a 40-foot gate funded 80 percent by the project and 20 percent by the County (if approved by project authorities); (b) the City Council's agreement to vacate and transfer to the County a .29 acre piece (Parcel "E") of street right of way on the east side of the Highway Department property pursuant to Section 66.296(2), Stats., which vacation would be without assessment of benefits to the County or assessment for improvement of the remainder; (c) the City's waiver of its option under Resolution 93-26.

If the Board approves this transaction, the County will receive payment for lands transferred to the City in the amount of $34,380. The County will not be obligated to pay special assessments. The County will obtain about one-half acre of usable property in exchange for unusable wetland.

Upon completion of the project, the County will have a fenced northern lot line, a new access to Highway 26 and County Trunk "N" over a bridge which will adequately support County vehicles, which will assist in the efficient delivery of County Highway services, and the cash payment set forth above.

The Highway Committee respectfully requests approval of the following resolution authorizing the transfer of property to the City of Jefferson. A map of the area is included, together with the City's draft offer and the Committee's minutes, which will form the basis of the final contract, if approved.

WHEREAS, the Jefferson County Board of Supervisors has previously offered right of way to the City of Jefferson for extension of Puerner Street across Highway Department land westerly from Highway 26 to the Rock River, and

WHEREAS, said previous offer needs to be modified to accommodate the relocation of the bridge southerly, and

WHEREAS, it is mutually beneficial to the City of Jefferson and the County of Jefferson to work together to site the North Street bridge replacement at the Puerner Street location,

NOW, THEREFORE, BE IT RESOLVED that the County of Jefferson transfer to the City of Jefferson the following described real estate on the terms and conditions contained in the annotated draft agreement for purchase and sale of real estate and the December 4, 1996 Jefferson County Highway Committee minutes regarding such agreement:

Fee title for the owner's interest in land contained within the following described tract being part of the Southeast 1/4 of the Northwest 1/4 and the Northeast 1/4 of the Southwest 1/4 of Section 2, Township 6 North, Range 14 East, City of Jefferson, Jefferson County, Wisconsin:

Commencing at an aluminum monument at the Southwest corner of said Northwest 1/4; thence South 88° 25'14" East, on and along the South line of said Northeast 1/4, 1,593.99 feet to the proposed South right of way line of West Puerner Street and the point of beginning; thence South 62° 04'54" West, 73.87 feet; thence South 73° 52'26" West, 155.86 feet to a point on the East bank of the Rock River; thence Northerly, on and along said East bank, to a point that is North 47° 42'15" West, 166.89 feet; thence North 73° 52'28" East, 375.64 feet; thence North 65° 05'40" East, 151.87 feet to point "A"; thence South 17° 30'14" East, 26.10 feet; thence Easterly 201.92 feet, along the arc of a curve concave to the North having a radius of 853.22 feet (the chord bears North 74° 27'22" East, 201.45 feet); thence North 81° 14'09" East, 281.28 feet to a point on the West line of Lot 1 of C.S.M. BE IT FURTHER RESOLVED the Jefferson County Clerk may sign a deed conveying the above described right of way, together with temporary limited easements as described in the agreement to the City.

BE IT FURTHER RESOLVED that the Jefferson County Administrator is authorized to execute the final contract documents which shall be in conformance with the annotated draft and Highway Committee minutes above described.

THE COUNTY BOARD OF SUPERVISORS OF THE COUNTY OF JEFFERSON, STATE OF WISCONSIN, DO ORDAIN AS FOLLOWS:

Section 4 of the County Traffic Ordinance (SPEED ZONES ON COUNTY TRUNK HIGHWAYS) is amended by adding the following:

COUNTY TRUNK HIGHWAY "K", TOWN OF KOSHKONONG, JEFFERSON COUNTY

  • Forty-five miles per hour for all vehicles from a point 0.12 of a mile south of its intersection with Star School Road, northerly to a point 0.12 of a mile south of its intersection with Liebermann Road.
  • This ordinance amendment shall be effective upon passage, publication and erection of official signs.

    Mr. Maasz moved that Ordinance No. 96-26 be adopted. Seconded and carried by the following roll call:

    The County Board of Supervisors of Jefferson County does hereby ordain that Section 3.01(2) of the County Board Rules is amended as follows:

    (2) Board meetings shall commence at 8:30 a.m., except Board meetings from May through October which shall commence at 7:00 p.m., unless by majority vote the Board prescribes a different time for convening.

  • [Note: Section 3.09 of the Board Rules provides that Section 3.01(2) may be amended upon majority vote at any regular meeting without necessity of laying such amendment over until the next regular session or suspension of the rules.]

    Mr. Lehmann read Report No. 9 of the Zoning Committee.

    TO THE HONORABLE MEMBERS OF THE JEFFERSON COUNTY BOARD OF SUPERVISORS

    The Jefferson County Planning and Zoning Committee, having considered a petition to amend the Zoning Ordinance of Jefferson County, filed for public hearing October 22, 1996 as required by law pursuant to Wisconsin Statutes, notice thereof having been given, and being duly advised of the wishes of the town boards and persons in the areas affected, hereby makes the following recommendation:

    DENIAL OF PETITION 1833A-96

    Petition 1833A-96 was filed by John F. Ebbott, David and Fran Tillotson, Karen Cahill, Greg David, Martine Koeppel and William Reichertz for an ordinance revision to temporarily prohibit, until the Jefferson County land use Plan 2020 is completed and adopted by the Jefferson County Board of Supervisors, the zoning reclassification of all property (within the County Zoning Office's jurisdiction) now in an Agricultural A-1 district to Agricultural A-2, Agricultural A-3 and Residential R-2. In addition, the petitioners request that the following language be added to the Zoning Ordinance in 11.04(f)5. Agricultural A-2 Principal Uses: "A residence or dwelling which does not meet the foregoing 'livelihood substantially derived from farm occupation' test is not a permissible principal use."

    The Committee is recommending denial due to the overwhelming response by the 15 towns in opposition to such a proposal, with one town responding in favor of the petition.

    WHEREAS, the Jefferson County Board of Supervisors has heretofore been petitioned to amend the Jefferson County Zoning Ordinance, and

    WHEREAS, Petition 1833A-96 was referred to the Jefferson County Planning and Zoning Committee for public hearing on October 22, 1996, and

    WHEREAS, the proposed amendment has been given due consideration by the Board of Supervisors in open session,

    NOW, THEREFORE, BE IT ORDAINED that the Jefferson County Board of Supervisors does deny Petition 1833A-96 and that no change shall be allowed:

    Ordinance revision to temporarily prohibit, until the Jefferson County land use Plan 2020 is completed and adopted by the Jefferson County Board of Supervisors, the zoning reclassification of all property (within the County Zoning Office's jurisdiction) now in an Agricultural A-1 district to Agricultural A-2, Agricultural A-3 and Residential R-2. The adoption of Plan 2020 by the Board of Supervisors is projected for late 1997 or early 1998. The Agricultural A-2 zone is an agribusiness zone allowing one single family residence per lot as a principal use; the A-3 zone is a rural residential zone with minimum lot size of one acre allowing for one single family residence per lot as a principal use; and the R-2 zone is a residential zone with minimum lot size of 20,000 square feet allowing for one single family residence per lot as a principal use. This revision would, in effect, eliminate any new land divisions for the purpose of single family dwellings served by private sewage systems.

    In addition, the petitioners request that the following language be added to the Zoning Ordinance in 11.04(f)5. Agricultural A-1 Principal Uses: "A residence or dwelling which does not meet the foregoing 'livelihood substantially derived from farm occupation' test is not a permissible principal use."

    Mr. Weiss moved that Ordinance No. 96-28 be adopted. Seconded.

    The Jefferson County Planning and Zoning Committee, having considered petitions to amend the Zoning Ordinance of Jefferson County, filed for public hearing September 19, October 17, and November 19, 1996 as required by law pursuant to Wisconsin Statutes, notice thereof having been given, and being duly advised of the wishes of the town boards and persons in the areas affected, hereby makes the following recommendations:

    APPROVAL OF PETITIONS 1706A-95-96M, 1783A-96M, 1837A-96,

    1838A-96, 1841A-96, 1842A-96 AND 1843A-96

    DENIAL OF PETITIONS 1758A-96M,

    1840A-96 AND 492-80-96M

    Petition 1758A-96M was filed by Rodell Lea to create a new residential building site on Scheppert Road in Oakland Township. This is recommended for denial due to the Town Board's veto of the request.

    Lilabelle Armstrong filed Petition 1840A-96 in order to create a new residential building site along CTH B in Lake Mills Township. The request is recommended for denial because it is made up entirely of Class III prime agricultural soils.

    Petition 492A-80-96M was a request by Henry Howe to further divide an A-3 lot to create two additional lots from a property on Stoney Creek Road in the Town of Lake Mills. The Committee is recommending denial because it determined that additional lots would potentially negatively impact soils that have prime agricultural soil classifications. Additional lots would be contrary to the agricultural preservation plan in place to preserve such soils.

    WHEREAS, the Jefferson County Board of Supervisors has heretofore been petitioned to amend the Jefferson County Zoning Ordinance, and

    WHEREAS, Petition 1783A-96M was referred to the Jefferson County Planning and Zoning Committee for public hearing on September 19, 1996, and Petitions 1706A-95-96M, 1837A-96, 1838A-96, 1841A-96, 1842A-96 and 1843A-96 were referred for public hearing on November 19, 1996, and

    WHEREAS, the proposed amendments have been given due consideration by the Board of Supervisors in open session,

    NOW, THEREFORE, BE IT ORDAINED that the Jefferson County Board of Supervisors does amend the Zoning Ordinance of Jefferson County (and accompanying zoning maps) as follows:

    FROM AGRICULTURAL A-1 TO A-3, RURAL RESIDENTIAL

    Modify the original request to allow creation of one 5.05 acre lot, proposed Lot 2, on CTH CI in the Town of Sullivan. This action is conditioned upon receipt by the Zoning Department of a soil test showing sites for installation of both initial and replacement private sewage systems, and upon approval and recording of the final certified survey map.     Modify the original request to allow creation of an approximate 1.25 acre lot with an existing home at W9591 Veith Road, Town of Waterloo. The new design shall show no more than 200 feet of road frontage which will begin at the northwest corner of the original proposal as shown on the preliminary survey. This rezoning is conditioned upon approval and recording of a final certified survey map. (1837A-96 - Brent & Regina Mosher)

    Create three wooded residential building sites, one of 4.5 acres, one of 4 acres and one of 3.3 acres from part of Parcels 05-13-09-33 (40 Acres) and 05-13-09-34 (40 Acres). The property is along STH 106 in the Town of Sumner. This action is conditioned upon receipt by Zoning of a soil test for each lot showing sites for installation of both initial and replacement private sewage systems, and for approval and recording of a final certified survey map.     Rezone 12.2 acres for a new residential building site along Poeppel Road from Parcel 05-14-16-23 (40 Acres) in the Town of Koshkonong. This site is within the urban service area of Fort Atkinson and is adjacent to existing residential zones. Rezoning is conditioned upon receipt by the Zoning Department of a soil test showing sites for installation of both initial and replacement private sewage systems, and upon approval and recording of a final certified survey map.     Rezone 1 acre with existing home at N3152 Will Road for change of ownership. Parcel 06-15-30-23 (13.167 Acres) is in the Town of Hebron. This action is conditioned upon approval and recording of a final certified survey map. (1842A-96 - Betty Schroedl)

    Create an 8 acre lot with existing home at W3064 Piper Road in the Town of Cold Spring. Parcels 05-15-34-43 (40 Acres) and 05-15-26-12 (5 Acres) are owned by Leslie H. and Berte Salov.     WHEREAS, Petition 1758A-96M was referred to the Jefferson County Planning and Zoning Committee for public hearing on October 17, 1996 and Petitions 1840A-96 and 492A-80-96M were referred for public hearing on November 19, 1996, and

    WHEREAS, the proposed amendments have been given due consideration by the Board of Supervisors in open session,

    NOW, THEREFORE, BE IT ORDAINED that the Jefferson County Board of Supervisors does deny Petitions 1758A-96M, 1840A-96 and 492-80-96M and that no change shall be allowed:

    MODIFICATION OF EXISTING A-3 ZONE
