Jefferson County Treasurer

Deputy County Clerk Frank read a letter addressed to Sheriff Quamme from Bob Hill, Inspector for the Wisconsin Department of Corrections. The annual inspection of the Jefferson County Jail was conducted on November 5, 1996. Only a couple of minor maintenance or repair items were listed and the report was generally very complimentary.

The letter was ordered received and placed on file.

Deputy County Clerk Frank reported that a claim has been received from the attorney for Gerald Wollin for $50,000 for physical, mental and emotional distress, chiropractic and medical treatment and attorney's fees arising out of an alleged false arrest as previously presented to the Board in a notice of claim on April 16, 1996. This matter has been referred to the County's insurer.

The claim was ordered received and placed on file.

Mr. Pieterick present.

Deputy Clerk Frank reported that a claim has been received from Mr. Thomas Ponchik who claims damages in the amount of $30,000 from the acts of the Sheriff and various deputies during his stay in the Jefferson County Jail. Mr. Ponchik claims that the food was inadequate and the phone was too expensive, amongst other items. This matter has been referred to the County's insurer.

The claim was ordered received and placed on file.

The Deputy Clerk reported that the County has received an amended notice of claim from Larry Rasmussen whose original claim was presented to the Board on October 8, 1996. The amended notice of claim adds several new people who are alleged to have, amongst other things, caused injury to Mr. Rasmussen by their involvement in his divorce action as it proceeded through the court system.

The claim was ordered received and placed on file.

The Deputy County Clerk read a Notice of Public Hearing from the Zoning Committee. Petitions for Zoning changes from the following persons are on the hearing agenda for Thursday, January 19, 1997 at 7:00 p.m.: Jerry Mosher, Town of Lake Mills; Scott and Julie P. Halvorsen, Town of Lake Mills; Erich H. Heinichen, Town of Concord; Noreen Hooper, Town of Sumner; Kathleen A. Kruk, Town of Jefferson; John Ovadal, Town of Farmington; Ron Duesterbeck, Town of Concord; Daniel Malone, Town of Concord; G. Robert Telfer, Town of Milford; and Richard Preuninger, Town of Sumner.

Mrs. Turner moved that the minutes of the December 10, 1996 meeting be approved as corrected. Seconded and carried.

As a Special Order of Business Mary Beth McDonald of Fort Atkinson and Dr. Michael Grajewski of Watertown gave a presentation on the Dodge-Jefferson Healthier Community Partnership.

As a Special Order of Business Mr. Tom Jennings of Jennings and Associates presented the Fair Park Plan Update and Report.

REGARDING EQUIPMENT PURCHASES

BIDS FOR WHEEL TRACTOR LOADERS

1) Volvo L120C - Bid proposed by Aring Equipment, Madison, WI

The bid documents were incomplete and inaccurate. Standard equipment specified in the bid documents was not included in the bid proposal. At a later date, after all bids were opened, an additional amount was quoted to add in the equipment that should have been included in the original bid price. Also, several items on the bid proposal sheets were inaccurately represented as meeting specifications. Upon review of the proposal by department staff, it was found that some of the equipment specifications were not met. There was no written explanation regarding the items not meeting specifications, even though there is a designated area provided for that purpose on the bid proposal sheets.

The unit bid does not meet specifications. Bid specifications called for a planetary design transmission. The unit bid has a counter shaft design style. Bid specifications also called for the main frame articulation joint to be a "pin and dual tapered roller bearing assembly." The unit bid has this type of bearing on the bottom half of the joint, but has another type of bearing on the top half of the joint.

2) Fiat Allis FR160.2 - Bid proposed by Kelbe Brothers, Inc., Madison, WI

The unit bid does not meet specifications. The loader capacity is under specifications. The machine weight is under specifications. The horsepower rating is under specifications. In general, this unit is in a smaller equipment classification than the type that was specified in the bid documents.

BIDS FOR SINGLE AXLE TRUCK BODIES WITH ATTACHMENTS

Gallion Team 2000 - Bid proposed by Team Wisconsin, Marshfield, WI

The unit bid does not meet specifications. The dump bodies bid does not meet specifications for the steel gauge thickness on the truck body sides and rub rails.

Mr. Foskett read Resolution No. 96-66.

WHEREAS, the State of Wisconsin has rescinded, (effective January 1, 1996), current law which requires counties to operate a GENERAL RELIEF PROGRAM, and

WHEREAS, the State of Wisconsin has severely restricted reimbursement to counties for operating this program, effective January 1, 1996, and

WHEREAS, the State of Wisconsin has via the 1995-1997 Biennial Budget Act 27 created a new Relief Block Grant Program (RBG), and

WHEREAS, this act allows counties to develop their own programs or discontinue all programs, and

WHEREAS, after due consideration by the Human Services Board of available State and County funds, and public need,

NOW, THEREFORE, BE IT RESOLVED that Jefferson County will continue to provide public General Relief services in the following manner for 1997.

  • 1. Pre-Authorized Medical Care will continue to be provided to income and asset eligible persons.

    2. Emergency Medical Services formerly known as Hospital Emergency Medical Notice will continue to be eliminated.

    3. The General Relief Shelter Program will continue to be eliminated.

  • BE IT FURTHER RESOLVED that if actual expenditures exceed 1997 planned expenditures, $59,400, that this matter may be brought back to the County Board for further action. Recommendations and rationale for program continuation or elimination to be developed by the Human Services Board.

    Note: A shelter program which is currently funded by a private community service organization will continue as a last resort program for persons in need.

    Mr. Buchanan read Resolution No. 96-67.

    WHEREAS, the Countryside Professional Nurses Union, Local 723(U), and the Jefferson County Personnel Committee agree that certain amendments should be made to the contract and the Memorandum of Understanding attached thereto,

    NOW, THEREFORE, BE IT RESOLVED that Paragraph I(c) of the Memorandum of Understanding shall be amended to read:

  • Additional Selection: On the sixteenth (16th) and the seventeenth (17th) of the month, additional hours will be granted based on seniority, regardless of full-time or regular part-time status. Employees with occasional part-time status are not eligible for hours granted on the sixteenth (16th) or seventeenth (17th). After the seventeenth (17th), additional hours will be granted on a first come, first served basis to nursing employees.
  • BE IT FURTHER RESOLVED that Section 12.02 of the Contract be amended to read as follows:

  • A premium will be paid to nurses for working an additional eight (8) hour shift to meet staffing needs as follows:
  • 1. FULL-TIME PERSONNEL (a) A $30 premium will be paid for each full shift worked, any part of which is over forty (40) hours per week.

    (b) A $50 premium will be paid for working an unscheduled additional eight (8) hour shift Friday through Sunday.

    (c) The above premiums are noncumulative. The employee shall be entitled to the greater of any premium which may be applicable.

    2. PART-TIME PERSONNEL AND OCPT (a) A $30 premium will be paid for shifts, any part of which exceeds forty (40) hours per week. A $30 premium will be paid for additional shifts scheduled on the same calendar day through the call-in procedure.

    (b) A $50 premium will be paid for any additional unscheduled shift Friday through Sunday, regardless of whether the employee has worked forty (40) hours per week.

    (c) The call-in premium and any other premium are noncumulative. The employee shall be entitled to the greater of any premium which may be applicable.

  • BE IT FURTHER RESOLVED that the foregoing amendments shall be effective upon ratification by the Union.

    The Jefferson County Planning and Zoning Committee, having considered petitions to amend the Zoning Ordinance of Jefferson County, filed for public hearing on November 19, 1996 and December 19, 1996 as required by law pursuant to Wisconsin Statutes, notice thereof having been given, and being duly advised of the wishes of the town boards and persons in the areas affected, hereby makes the following recommendations:

    WHEREAS, the Jefferson County Board of Supervisors has heretofore been petitioned to amend the Jefferson County Zoning Ordinance, and

    WHEREAS, Petitions 1835A-96 and 1836A-96 were referred to the Jefferson County Planning and Zoning Committee for public hearing on November 19, 1996 and Petitions 1844A-96, 1845A-96, 1846A-96, 1847A-96, 1850A-96, 1853A-96, 1854A-96 and 1810A-96M were referred for public hearing on December 19, 1996, and

    WHEREAS, the proposed amendments have been given due consideration by the Board of Supervisors in open session,

    NOW, THEREFORE, BE IT ORDAINED that the Jefferson County Board of Supervisors does amend the Zoning Ordinance of Jefferson County (and accompanying zoning maps) as follows:

     

     

     

     

    FROM RESIDENTIAL R-2 TO AGRICULTURAL A-1

    Rezone 5.2 acres at W7050 CTH A to Agricultural A-1 in order to bring the property into conformance with its existing farm use. Parcel 07-14-06-43 (28.42 Acres) is in the Town of Milford. (1844A-96 - Donald and Vera Belle Flood)

    FROM AGRICULTURAL A-1 TO A-2

    Rezone a part of Parcel 06-15-09-43 (16.5 Acres) at N4102 Bear Hole Road in the Town of Jefferson. This action is conditioned upon receipt and approval by the Zoning Department of a preliminary certified survey map consistent with the applicant's drawing identifying the area to be rezoned.     FROM AGRICULTURAL A-1 TO A-3, RURAL RESIDENTIAL

    Rezone 2.34 acres with existing buildings at N9162 Ash Road from Parcel 08-15-12-22 (21.4 Acres) in the Town of Watertown. This action is conditioned upon approval and recording of a final certified survey map. (1836A-96 - Leroy H. Nemitz)

    Rezone 6.36 acres of Parcel 07-15-17-42-001 (20.144 Acres) for a new residential building site. No cultivatable land shall be rezoned, with the exception of the 66 foot access strip. The property is on Christberg Road in the Town of Farmington; this action is further conditioned upon receipt by Zoning of a soil test showing sites for installation of both initial and replacement private sewage systems, and upon approval and recording of a final certified survey map.     Modify the original request and rezone to create one, ten acre wooded residential building site from part of Parcels 07-15-29-41 (40 Acres) and 07-15-29-44-001 (10 Acres) in the Town of Farmington near N5407 Switzke Road.
