WHEREAS, the Office of County Clerk is currently vacant due to the passing of the incumbent, Barbara A. Geyer, and

WHEREAS, Section 17.21 of the Statutes provides that a vacancy in the Office of the County Clerk shall be filled by appointment by the County Board for the balance of the unexpired term, and

WHEREAS, Barbara A. Frank, Chief Deputy County Clerk, has thirteen years experience in the Office of the County Clerk and is currently the Accounting Coordinator, and is, by virtue of her training and experience, well qualified for the position of County Clerk,

NOW, THEREFORE, BE IT RESOLVED that Barbara A. Frank is hereby appointed County Clerk for the remainder of the unexpired term of Barbara A. Geyer.

Mr. Kisow moved that Resolution No. 96-68 be adopted. Seconded and carried by the following roll call:

County Clerk Barbara A. Frank read a note of thanks from the family of Barbara A. Geyer for the flowers and condolences sent on the recent death of the former County Clerk.

The communication was ordered received and placed on file.

County Clerk Frank read a letter from Helen Stowe, Coordinator for Jefferson County Christmas Neighbors, Inc. thanking the Board for allowing Christmas Neighbors to use the Activity Building for the annual toy distribution program in December.

The letter was ordered received and placed on file.

The County Clerk read a memorandum from Joe Nehmer, Coordinator of Information for the Jefferson County Local Emergency Planning Committee, asking that the name of John Marofske be removed from the Committee as Mr. Marofske has moved from the area.

The communication was ordered received and placed on file.

The County Clerk read a Notice of Public Hearing from the Zoning Committee. Petitions for Zoning changes from the following persons are on the hearing agenda for Thursday, February 20, 1997 at 7:00 p.m.: Jone M. Mr. Jaeger read Resolution No. 96-69.

WHEREAS, God in his infinite wisdom decreed to take in death on January 11, 1997 Jefferson County Clerk Barbara A. Geyer, and

WHEREAS, Barbara A. Geyer began her employment with the County Clerk's office in February, 1960, and was elected Jefferson County Clerk in 1976, being re-elected continuously until the time of her death, and

WHEREAS, County Clerk Barbara A. Geyer demonstrated leadership, directness, professionalism and humor in the administration of her office on behalf of the citizens of Jefferson County, and

WHEREAS, the determination and courage shown by Barbara A. Geyer will remain as an inspiration to us all and that we will cherish her memory.

NOW, THEREFORE, BE IT RESOLVED that we, the members of the Jefferson County Board of Supervisors assembled at our regular February meeting pause in remembrance of Barbara A. Geyer, in recognition of her public service and contributions to good government, and

BE IT FURTHER RESOLVED that we remember Barbara A. Geyer as a friend to all, and hereby extend to her family our sincere sympathy in this their bereavement and pray that God will watch over and protect them.

The annual report of the Jefferson County Fair was presented by Gail Zastrow, secretary in the County Fair Office.

General

Grounds improvement began in the north parking lot area. A new north-south road was brought in from Spangler Road toward the Activity Center. Fencing was placed to the east and north to accommodate the new entrance when Jackson Street goes through. The new entrance sign which has been donated by the Agri-Business Club serves as a foundation for many of the changes to come. This year will be very exciting as we begin the expansion.

The indoor Horse Arena was dressed up with efficient lighting. The Rabbit Barn and shop exchanged buildings to get the rabbit exhibits in the Fair traffic pattern. The square footage was increased for the shop in the change.

Rental income was up. The Activity Center is booked every weekend with some having two events on the same day. UW-Extension has increased their use of the facilities for 1996.

Fair Week

In 1996 we saw an increase in attendance by about 20%. The weather was excellent with no 100 degree days and only light drizzle. No events had to be cancelled. The grandstand entertainment was well attended. On Friday evening, our first ever fireworks went off without a hitch. The Liebel Family Circus performed three shows per day and this year we also added Kandu and Company magic show with thanks to Havill-Spoerl for sponsoring the show. Admission ticket prices remained the same. Kid's Day was attended by over 500 children on Wednesday, with Thursday dedicated to the Seniors. Sponsorship realized an increase with new sponsors for 1996.

The seven quality young ladies competing for the Fairest of the Fair title had fun during the events. On the first day of their interviews and radio spots they had a limo ride from the Courthouse to WSLD radio station and then returned to Miss Kitty's for personal interviews. Sadi Jo Meidl of rural Watertown was chosen as our 1996 Jefferson County Fairest of the Fair. She participated this fall and winter and will continue to participate next spring and summer in parades throughout the County. We had businesses from the entire Jefferson County area donate prizes to each of the contestants. Previous Fairest of the Fairs helped to make this program a true success this year. Sadi competed at the annual Wisconsin Association of Fairs convention in Milwaukee January 6 - 8. Sadi did very well during the competition, finishing as the second runner-up out of the 26 Fairest of the Fairs from all around the state. We are very proud of Sadi.

The Jefferson County Fair would not be the success it has grown to be without the excellent help of the County Highway Department. This summer alone they assisted with the moving of the track (extending it to the south and removing one of the curves), tiling on the west side, the road extension by the Jackson Street entrance into the new parking lot, preparing the track for grandstand events, and in general being available during the Fair with the equipment that is needed. Thank you to the Highway Department and Committee.

The Sheriff's Department is another department that we rely on to present "The Fair That Always Pleases." They provide security during the operating hours of the Fair and also on foot and golf cart patrol overnight to ensure the safety of campers and exhibitors' displays.

FAIR PARK EXPANSION

The Committee has retained a Master Planner, Tom Jennings of Jennings & Associates, and began the process to determine what is needed here long term. Following many meetings, one Master Plan had been chosen. At the end of 1996 we investigated ways to secure additional funding to proceed with expansion. Toward this end, a professional fund raiser will be retained for 1997, getting us ready for the next steps for involving the community and to prepare for the Sesquicentennial for the State of Wisconsin in 1998 and the Fair Park itself shortly thereafter.

With the help of this County Board, the Jefferson County Fair Park will continue to serve the growing needs of the community.

Mr. Buchanan read Resolution No. 96-70.

WHEREAS, on January 8, 1997, Jefferson County received a notice of claim from the attorney for Gerald R. Wollin of N6839 Budig Lane, Johnson Creek, Wisconsin, for medical and chiropractic treatment expenses, attorney's fees, and physical, mental and emotional distress as a result of being arrested by Jefferson County Sheriff's Deputies on November 28, 1995,

NOW, THEREFORE, BE IT RESOLVED that the Jefferson County Board of Supervisors hereby disallows said claim and directs the Corporation Counsel to give notice of said disallowance.

Mr. Buchanan read the following report submitted by the Budget and Parks Committees:

TO THE HONORABLE MEMBERS OF THE JEFFERSON COUNTY BOARD OF SUPERVISORS:

Rock County owns the Indianford Dam. They must operate this dam consistent with operating orders issued by the Wisconsin Department of Natural Resources. Rock County utilizes data from four different gaging stations to help with those orders.

The Rock Island Corps of Engineers has decided to discontinue funding of one of these stations on the Crawfish River at Milford. Due to federal cutbacks, the Corps will not provide funding for this gage station for FFY 1997.

The total cost to operate the gage station in FFY 1997 is $8,700.00. The United States Geological Survey is willing to contribute $4,350.00 if Rock County provides the remaining $4,350.00. Rock County has requested that Jefferson County consider funding 50% of their $4,350.00 ($2,175.00).

The information provided by this gage station is important to the operation of the Indianford Dam. The Indianford Dam influences the water level of Lake Koshkonong, which is primarily in Jefferson County.

Lake Koshkonong and its tributaries can pose significant flooding concerns for the County of Jefferson. TO THE HONORABLE MEMBERS OF THE JEFFERSON COUNTY BOARD OF SUPERVISORS:

This report is being sent along to support a joint resolution from the Budget and County Fair Committees which you will be asked to act upon at the February meeting of the County Board.

Please review the Jefferson County Fair Park Master Plan report which was distributed at the January meeting. This plan provides this county with a road map showing a sensible route to achieve the following objectives:

  • 1. Accommodate the disruptions in this facility caused by the Jackson Street extension through the Fair Park.

    2. Establish a comprehensive engineering system to manage utilities and storm water drainage for both present and future needs.

    3. Define the market which will support this facility in the future, thus ensuring that this community achieves maximum benefit from investments made in this Fair Park.

    4. Identify capital projects which may be accomplished through fund raising from private sources as opposed to tax dollars.

  • The joint resolution funds activities which will allow the county to take the first important steps in realizing this plan. The Fair Ccommittee has taken great care in identifying those projects which are absolutely critical to establish this Fair Park on a firm foundation upon which to grow in a most efficient manner. The projects - and accompanying estimate for cost - are as follows:

    HIGHWAY COMMITTEE REPORT

    REGARDING BIDS FOR A PATROL SUPERINTENDENT VEHICLE

    The Highway Committee received bids on January 29, 1997 for the purchase of a Patrol Superintendent vehicle. Historically, the Highway Department has purchased full-size vehicles for Superintendent use. This practice was followed in part to provide additional safety for the individuals using these vehicles on a daily basis, often during adverse conditions during winter months. Purchasing of full-size vehicles with government discounts applied by manufacturers also made this practice cost effective. As an example of the cost effectiveness, the Highway Department purchased two Ford Crown Victoria vehicles for the price of $13,700 each in 1994.

    In order to get comparative costs on full-size versus mid-size vehicles for this use, the Highway Committee advertised for bids on both types of vehicles.

    After review of the bids received for both types of vehicles, the difference in price between the low bids in each category was more substantial than anticipated. We learned that due to the fact that Chevrolet no longer makes a full-sized vehicle for police and municipal use to compete with the Ford Crown Victoria, the manufacturer's governmental discounts on these full-sized vehicles had been significantly reduced.

    Therefore, the Highway Committee has decided to recommend the purchase of a mid-size vehicle as a result of this bid letting at this time. Future purchasing decisions will be evaluated to determine if full-size vehicles can be purchased cost effectively. If so, we may choose to make future vehicle purchases in the larger classification for the stated safety reasons.

    NOW, THEREFORE, BE IT RESOLVED that the Jefferson County Board of Supervisors respectfully requests that State of Wisconsin aids to library systems be increased to those systems which do not charge non-residents for inter-library loans of materials, which would solve "border problems" and provide for more equalized and better access to libraries throughout the State of Wisconsin.

    BE IT FURTHER RESOLVED that a copy of this resolution be sent by the County Clerk to all Jefferson County State Senators and State Representatives.

    AN ORDINANCE TO CREATE SECTION 96-1 OF THE ZONING CODE OF THE TOWN OF PALMYRA REGARDING DUPLEXES AND MULTI-DWELLING UNITS

    WHEREAS, the Town of Palmyra has adopted the Jefferson County Zoning Ordinance as the zoning ordinance for the Town of Palmyra, and

    WHEREAS, the Town Board of the Town of Palmyra wishes to amend the definitions of that ordinance as it relates to duplexes and multi-dwelling units within the Town of Palmyra,

    NOW, THEREFORE, the Town Board of the Town of Palmyra, Jefferson County, Wisconsin, does ordain as follows:

    SECTION 1:

    Section 96-1 of the Town of Palmyra Municipal Code is hereby created to read as follows:

    96-1 Duplex and Multi-Dwelling Units

  • (1) The definition of duplex and/or multi-dwelling units, not currently defined in Sec. 11.02 of the Jefferson County Zoning Ordinance is hereby defined, for the purpose of interpretation of any and all references to duplex and/or multi-dwelling units in the Jefferson County Ordinance, utilizing the following language:

    Duplex and/or multi-dwelling units shall include all habitable structures containing two or more kitchen facilities. Kitchen facilities are identified as an area within the habitable structure designed for meal preparation, utilizing electrical and plumbing fixtures in the specific kitchen area. The number of kitchen facilities shall identify the structure as duplex and/or multi-dwelling unit. For clarification purposes, a dwelling unit occupied by only one family could, in effect, be classified as a duplex or multi-dwelling unit under this definition if it contains multiple kitchen facilities.

    (2) Any division of any existing home converting it to a duplex or multiple dwelling as defined by paragraph (1) for the purpose of creating rental property will automatically be classified as a multiple dwelling.

  • SECTION 2:

    The sections of this ordinance are declared to be severable. If any section or portion thereof shall be declared by a court of competent jurisdiction to be invalid, unlawful or unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision, and shall not affect the validity of any other provisions, sections or portions thereof of the ordinance. The remainder of the ordinance shall remain in full force and effect. Any other ordinance whose terms are in conflict with the provisions of this ordinance are hereby repealed as to those terms that conflict.

    SECTION 3:

    This ordinance shall take effect immediately upon passage and posting or publication as provided by law.

    (b) The word "person" shall be construed to include an individual, partnership, firm, company, corporation, whether tenant, owner, lessee, licensee, or other agent, heir, or assign.

  • 2. All homes, built, constructed or placed on any lot or property in the town shall be at least twenty-four (24) feet wide.

    3. All homes shall have a minimum square footage of 1160 square feet.

    4. All homes shall at a minimum have a 4:12 pitch roof.

    5. All homes shall have full frost footings, not just columns or pilings below the frost line, or a full basement.

    6. A temporary permit for a mobile home may be issued at the Town Board's discretion and the length of this temporary permit shall be determined by the Town Board.

    7. The Town Board adopts all of the requirements of the Uniform Dwelling Code and said requirements of the Uniform Dwelling Code shall be incorporated herein by reference.

    8. This ordinance supersedes all prior ordinances regulating all types of homes. The terms of this ordinance shall control as to any issues regarding homes.

    9. Should any section, clause, or provision of this ordinance be declared by the courts to be invalid, the same shall not affect the validity of the ordinance as a whole or any part thereof, other than the part so declared to be invalid.

    10. If any person violates this ordinance, the Town shall be entitled to an immediate injunction, and the home shall either be made to be in compliance with this ordinance or removed from the Town of Farmington. The Town shall be entitled to actual attorneys fees and all other costs incurred in enforcing this ordinance.

    11. In addition to the penalties stated above, a person may be fined an indefinite amount of money not to exceed $100.00 per day for each day the person is not in compliance with this ordinance.

    12. This ordinance shall take effect and be in full force from and after the date of its passage and publication according to law.

    Mr. Lehmann moved that Resolution No. 96-76 be adopted. Seconded and carried.
