Mr. Munyon moved that the minutes of the May 8, 2001, meeting be approved as corrected. Seconded and carried.

County Clerk Barbara A. Frank read a letter from State Senator Joanne B. Huelsman regarding Jefferson County Resolution No. 2001-05 relating to state funding for county jail inmates.

 

The letter was ordered received and placed on file.

 

County Clerk Frank read a Notice of Public Hearing from the Zoning Committee for a hearing that will be held on June 21, 2001, at 7:00 p.m.

 

The notice was ordered received and placed on file.

 

There were no dog damage claims.

 

The floor was opened for public comment.

 

Bob Rupprecht spoke regarding his request for rezoning of a site along STH 26 in the Town of Jefferson from Agricultural A-1 to Industrial to create a wholesale distribution site.

 

The regular order of business was resumed.

 

Ed Virnig of Virnig & Associates, LLC presented the audit report for the year ending December 31, 2000.

 

Mr. Keating moved that the audit report be accepted and placed on file. Seconded and carried.

The annual report of the Land Information Office was presented by Andrew J. Erdman, Department Head.

 

Mr. Lehmann moved that the report be accepted and placed on file. Seconded and carried.

 

County Surveyor Thomas R. Wollin presented the annual report for his office.

Gail Chamberlain, Director of the Jefferson County Health Department, presented the 2000 annual report for that department.

 

Mr. Zimdars moved that the report be accepted and placed on file. Seconded and carried.

 

Tom Schleitwiler , Director of the Human Services Department, presented the department's 2000 annual report.

 

Ms. Schreiber moved that the report be accepted and placed on file. Seconded and carried.

 

The 2000 annual report for the Workforce Development Center of Jefferson County was presented by Dawn Smith, Center Coordinator.

 

Ms. Schreiber moved that the report be accepted and placed on file. Seconded and carried.

 

Mr. Keating read Resolution No. 2001-16.

 

Resolved that in line with County policy regarding expenses at meetings outside the State of Wisconsin, the mileage and necessary expenses of Matthew Hanson, UW-Extension, Jefferson County Crops and Soils Agent, to attend the 2001 National Association of County Agricultural Agents Annual Meeting and Professional Improvement Conference in Albuquerque, New Mexico, from August 5 through August 9, 2001, be allowed, but not to exceed $500. Money to come from UW-Extension Account No. 68.512147.

Mr. Munyon read Ordinance No. 2001-07.

 

WHEREAS, Section 3.03(12) of the County Board Rules establishes the number of pages of an annual report which shall be printed in the minutes, and

 

WHEREAS, the Legislation & Rules Committee has reviewed the cost of publishing and printing the County Board minutes and believes savings will result from not routinely including annual reports in the minutes.

 

THE JEFFERSON COUNTY BOARD OF SUPERVISORS DO ORDAIN AS FOLLOWS:

 

3.03(12) of the County Board Rules shall be amended as follows:

 

(12) Annual reports will be received and placed on file and not printed in the minutes unless the Board otherwise directs.

 

This ordinance shall be effective upon passage and publication.

Mr. Keating presented Resolution No. 2001-17 and, because of its length, moved to suspend the vocal reading of same.

 

WHEREAS, the Personnel and MIS committees have developed uniform policies for use of County computers and Internet access, and

 

WHEREAS, the committees recommend that the Board adopt the following policy governing use of the County network and advise employees that this policy shall be considered a work rule

 

NOW, THEREFORE, BE IT RESOLVED that the following policy is adopted:

 

Jefferson County Computer Use

and Internet Access Policy

 

Statement

 

Jefferson County provides employees with access to and the use of a variety of information technology resources. These resources are provided to employees in an effort to allow them to be more efficient, productive, and to have access to information that is necessary for them to carry out their responsibilities as employees of the County. Employees are expected and required to use these information technology resources in a manner consistent with their position and work responsibilities with the County.

 

The Internet is a worldwide network of computers that contains millions of pages of information. Users are cautioned that many of these pages include offensive, sexually explicit, and inappropriate material. In general, it is difficult to avoid at least some contact with this material while using the lnternet. Even innocuous search requests may lead to sites with highly offensive content. Additionally, having an e-mail address on the Internet may lead to receipt of unsolicited e-mail containing offensive content. Users accessing the Internet do so at their own risk. Jefferson County is not responsible for material viewed or downloaded by Users from the Internet. To minimize these risks, your use of the Internet at Jefferson County is governed by the following policy:

Permitted Use of Internet and Jefferson County Computers

 

For the purposes of this policy, the County will define "Information Technology Resources" as any equipment, hardware or software that is assigned and available for employees to use in the course of their employment. "Employee" is defined as all regular full-time, regular or occasional part-time, limited term employees, contracted employees, seasonal employees, State of Wisconsin employees working within County government and volunteers who have been granted access to and use of Jefferson County's Information Technology Resources.

 

The computer and network are the property of Jefferson County and are to be used for legitimate business purposes. Users are provided access to the computer network to assist them in the performance of their jobs. Additionally, certain employees ("Users") may also be provided with access to the Internet through the computer network. All Users have a responsibility to use Jefferson County's computer resources and the Internet in a professional, lawful and ethical manner. Occasional limited appropriate personal use of the computer is permitted if approved by the department head and such use does not:

1. Interfere with the User's or any other employee's job performance; or

2. Have an undue effect on the computer or Jefferson County network's performance; or

3. Violate any other policies, provisions, or guidelines applicable to the Jefferson County employee.

Further, Users are responsible for the professional, ethical and lawful use of the computer system at all times. Personal use of the computer is a privilege that may be revoked at any time. Loss of e-mail, Internet access or Jefferson County computer privileges, sanctions or other actions up to and including termination may be imposed for failure to follow this policy.

Computer Network Use Limitations

 

Prohibited Activities. Without prior written permission from the MIS Committee, Jefferson County computers and network may not be used to disseminate, view or store commercial or personal advertisements, solicitations, promotions, destructive code (e.g., viruses, trojan horse programs, security cracking-avoidance tools, etc.) or any other unauthorized materials.

Unacceptable Use of Information Technology Resources

Unacceptable uses of the County's Information Technology Resources include, but are not limited to, the following:

1. Unauthorized use.

2. Illegal purposes.

3. Transmittal of threatening, abusive, obscene, lewd, profane or harassing material or material which suggests any lewd or lascivious act.

4. Inflammatory remarks about an individual's race, age, disability, religion, national origin, physical attributes or sexual preference; material containing abusive, profane or offensive language, solicitation of non-County business, Internet or e-mail usage for personal gain, illegal activity, or any usage contrary to Jefferson County's best interest.

5. Intentionally preventing or attempting to prevent the disclosure of your identity with the intent to frighten, intimidate, threaten, abuse or harass another person.

6. Transmittal of material which is confidential to the County.

7. Disruption of network services, such as distributing computer viruses.

8. Use of someone else's identity and password for access to information technology resources without proper authorization.

9. Attempt to evade, disable or "crack" password or other security provisions of systems on the network.

10. Reproduction and/or distribution of copyrighted materials without appropriate authorization. Users may not illegally copy material protected under copyright law or make that material available to others for copying. You are responsible for complying with copyright law and applicable licenses that may apply to software, files, graphics, documents, messages, and other material you wish to download or copy. You may not agree to a license or download any material for which a registration fee is charged without first obtaining the express written permission of the MIS Department.

Software Limitations

 

Installations. Only legal software may be installed on Jefferson County equipment. Software is considered legal if a software publisher has granted a right (or license) to Jefferson County to use one or more copies of its software and Jefferson County prohibits further copying and distribution of that software to others. All software installed on the Jefferson County network, pcs, and other related devices must be authorized and approved by the MIS Department. If you buy software yourself, the MIS Department must approve the purchase ahead of time. A copy of the purchase order and a copy of the license agreement must be provided to the MIS Department before the software may be purchased. Personal software installed on any County equipment is not allowed. No software should be downloaded off the Internet to the network or installed on County equipment without the assistance of the MIS Department to ensure proper licensing. Jefferson County equipment is any piece of hardware, software, firmware, pc, pda, telephony, or any other item purchased with Jefferson County funds. Only MIS staff or MIS contact people are allowed to install any software on the Jefferson County network or Jefferson County equipment.

Moving. Written requests for department computer equipment moves should be sent to the MIS Department – at least five days before the move is anticipated. Upon receipt of request, MIS staff will make arrangements to move or relocate equipment.

Duty Not to Waste or Damage Computer Resources

 

Accessing the Internet. To ensure security and avoid the spread of viruses, Users accessing the Internet through a computer attached to Jefferson County's network must do so through an approved Internet firewall or other security device. Bypassing Jefferson County's computer network security by accessing the Internet directly by modem or other means is strictly prohibited unless the computer you are using is not connected to Jefferson County's network.

Frivolous Use. Computer resources are not unlimited. Network bandwidth and storage capacity have finite limits, and all Users connected to the network have a responsibility to conserve these resources. As such, the User must not deliberately perform acts that waste computer resources or unfairly monopolize resources to the exclusion of others. These acts include, but are not limited to, staying on line when the browser is not in use for more than thirty minutes, sending mass mailings or chain letters, spending excessive amounts of time on the Internet, playing games, engaging in online chat groups, uploading or downloading large files, accessing streaming audio and/or video files, or otherwise creating unnecessary loads on network traffic associated with non-County-related uses of the Internet.

Virus Detection. Files obtained from sources outside Jefferson County, including disks brought from home, files downloaded from the Internet, newsgroups, bulletin boards, or other online services; files attached to e-mail, and files provided by customers or vendors, may contain dangerous computer viruses that may damage Jefferson County's computer network. Users should never download files from the Internet, accept e-mail attachments from outsiders, or use disks from non-Jefferson County sources, without first scanning the material with Jefferson County-approved virus checking software. If you suspect that a virus has been introduced into Jefferson County's network, notify the MIS Department immediately. All devices connected to the network must have virus protection installed on them by MIS and be updated at least bi-weekly.

County Purchased Equipment. All equipment connected to the Jefferson County network must be authorized by the MIS Department. Any violations of this will result in immediate disconnection from the Jefferson County network. The MIS Committee will consider requests for non-County equipment to be hooked to the Jefferson County network. The MIS Committee will examine each request and approve or deny the request. All equipment purchased is property of Jefferson County and is not the property of individual departments or individual Users unless the equipment is purchased through grant funds. If the equipment is purchased through grant funds, the grant terms determine ownership. This equipment must still conform to all of the standards maintained for County equipment. Spare equipment is under the charge of the MIS Department and shall be returned when the original piece of equipment is repaired or replaced. Personal hardware and software items may not be connected to Jefferson County equipment.

Security. Jefferson County employees will be responsible for maintaining the confidentiality of their User id's and passwords. When you leave your work area, you should always log off completely from your workstation. County employees shall notify the MIS Department immediately if they believe that unauthorized Users have obtained User id or password information to gain access to their User area or the Jefferson County network or other Jefferson County secure resources. It is the responsibility of the department head or MIS contact person to notify MIS to revoke terminated employee's access.

No Expectation of Privacy

 

Employees are given computers and Internet access to assist them in the performance of their jobs. Employees should have no expectation of privacy in anything they create, store, send or receive using Jefferson County computer equipment. The computer network and the information in it are the property of Jefferson County.

Waiver of Privacy Rights. Users expressly waive any right of privacy in anything they create, store, send or receive using Jefferson County's computer equipment or Internet access. Each User consents to allow authorized Jefferson County personnel access to and review of all materials created, stored, sent or received by User through any Jefferson County network or Internet connection.

Monitoring of Computer and Internet Usage. Jefferson County has the right to and does monitor and log any and all aspects of its computer system including, but not limited to, monitoring Internet sites visited by Users, monitoring chat and newsgroups, monitoring file downloads, and all communications sent and received by Users. Department heads and or MIS contact people and or MIS employees have access to User ids and passwords and can use them at any time for monitoring purposes or allowing access during employee absence.

Blocking Sites with Inappropriate Content. Jefferson County has the right to and does utilize software that makes it possible to identify and block access to Internet sites containing sexually explicit or other material deemed inappropriate in the workplace. If a block interferes with accessing work related sites, contact your department's MIS contact person and they will contact your department head and MIS about unblocking that site.

 

Other Information

 

Contact Person. Each department has a departmental contact person for MIS Department issues. This person, (either the department head or another designated individual or individuals), acts as the prime contact person for MIS Department issues. When individual employees have problems or questions, they should first seek out the department contact person as their first line of support. If the department contact person does not know the answer, then the department contact person will seek out the MIS Department for assistance.

Vendors. No vendors or outside entity shall come on site and be left alone with Jefferson County network access or related equipment without consent from the MIS Department. When vendors come on site, they are required to make appointments with the MIS Department at least 72 hours ahead of the visit. No vendor or outside entity shall be given any supervisory or administrative usernames or passwords.

Acknowledgement of Understanding

 

I have read and agree to comply with the terms of this policy governing the use of Jefferson County's computer network and other related equipment. I understand that violation of this policy may result in disciplinary action, including possible termination and civil and criminal penalties.

BE IT FURTHER RESOLOVED, that the Personnel Department shall distribute copies to all employees and obtain signed originals for the employees' files.

The Jefferson County Planning and Zoning Committee, having considered petitions to amend the zoning ordinance of Jefferson County, filed for public hearing held on February 15, March 15, April 19 and May 17, 2001, as required by law pursuant to Wisconsin Statutes, notice thereof having been given, and being duly advised of the wishes of the town boards and persons in the areas affected, hereby makes the following recommendations:

WHEREAS, the Jefferson County Board of Supervisors has heretofore been petitioned to amend the Jefferson County Zoning Ordinance, and

 

WHEREAS, Petition 2299A-01 was referred to the Jefferson County Planning and Zoning Committee for public hearing on February 15, 2001, Petition 2307A-01 was referred for public hearing on March 15, 2001, Petition 2324A-01 was referred for public hearing on April 19, 2001, Petitions 2322A-01, 2332A-01, 2336A-01, 2337A-01, 2338A-01, 2339A-01, 2340A-01, 2341A-01, 2342A-01, 2343A-01 and 2345A-01 were referred for public hearing on May 17, 2001, and

 

WHEREAS, the proposed amendments have been given due consideration by the Board of Supervisors in open session,

 

NOW, THEREFORE, BE IT ORDAINED that the Jefferson County Board of Supervisors does amend the zoning ordinance of Jefferson County (and accompanying zoning maps) as follows:

 

 

 

 

FROM AGRICULTURAL A-1 TO A-2, AGRIBUSINESS

 

Rezone 1.65 acre of PIN 006-0716-1644-000 (36.95 acres) to allow for agribusiness use. The site is at N6189 CTH F in the Town of Concord, and is currently owned by David R. Kamber. (2332A-01 – Donald E. Popp)

 

FROM AGRICULTURAL A-1 TO A-3, RURAL RESIDENTIAL

 

Rezone one acre along CTH A in the Town of Milford from part of PIN 020-0814-3431-001 (9.07 acres). This is considered a prime agricultural land lot; therefore, this approval is conditioned upon recording of an affidavit acknowledging use of all available A-3 zones for the property. It is further conditioned upon road access approval by the County Highway Department, upon receipt by Zoning of a soil test showing sites for installation of both initial and replacement private sewage systems, and upon approval and recording of a final certified survey map for the property. Modify the original request and allow rezoning of one acre of PIN 028-0513-0124-000 (15.125 acres) to allow a new residential building site near W7586 STH 106 in the Town of Sumner). This is considered a prime ag land lot; therefore, rezoning is conditioned upon recording of an affidavit acknowledging use of all available A-3 zones for the property.

 

Rezoning is further conditioned upon road access approval by the D.O.T. upon receipt by Zoning of a soil test showing sites for installation of both initial and replacement private sewage systems, upon extraterritorial plat review by the City of Fort Atkinson and upon approval and recording of a final certified survey map for the lot. Create two, 2-acre wooded lot along Dead End Road in the Town of Ixonia from part of PIN 012-0816-2942-000 (37.110 acres). This action is conditioned upon road access approval by the Town of Ixonia, upon receipt by Zoning of a soil test showing sites for installation of both initial and replacement private sewage systems and upon approval and recording of the final certified survey map for the property. Create a 2-acre building site along London Road in the Town of Lake Mills from part of PIN 018-0713-2943-001 (9.991 acres). Rezoning is conditioned upon receipt by Zoning of a soil test showing sites for installation of both initial and replacement private sewage systems, upon road access approval by the Town of Lake Mills, and upon approval and recording of a final certified survey map for the lot. Rezone to create a 2-acre building site along STH 89 in the Town of Lake Mills. The site is part of PIN 018-0713-2423-002 (16.27 acres). This is considered a prime ag land lot combination; therefore, rezoning is conditioned upon recording of an affidavit acknowledging use of all available A-3 zones for the property. The approval is further conditioned upon receipt by Zoning of a detailed plot plan showing proposed home and driveway location, upon road access approval by the D.O.T., upon receipt by Zoning of a soil test showing sites for installation of both initial and replacement private sewage systems, and upon approval and recording of a final certified survey map for the property. Create a 2-acre lot on Meske Road in the Town of Koshkonong from part of PIN 016-0514-2531-000 (24.544 acres). This is considered a prime ag land lot, utilizing all available A-3 zones for the property. Therefore, rezoning is conditioned upon recording of an affidavit acknowledging that fact. It is further conditioned upon road access approval by the Town, upon receipt by Zoning of a soil test showing sites for installation of both initial and replacement private sewage systems, and upon approval and recording of a final certified survey map for the property. Rezone to create a 1-acre lot around the existing home at N4547 CTH D, and a 2-acre vacant lot, also on CTH D. This Town of Jefferson property is part of PIN 014-0615-0234-001 (7.73 acres). Rezoning is conditioned upon the remaining A-1 zoned land being retained by the owner of proposed Lot 2, upon road access approval by the County Highway Department, upon receipt by Zoning of a soil test showing sites for installation of both initial and replacement private sewage systems for the vacant lot, and upon approval and recording of a final certified survey map for the property. Rezone to create a 2-acre vacant lot along CTH G in the Town of Jefferson. The property is part of PIN 014-0614-0623-000 (25.120 acres). This is considered a lot combination in prime agricultural soils utilizing all available A-3 zoned lots for the property. Therefore, rezoning is conditioned upon recording of an affidavit acknowledging that fact. It is further conditioned upon road access approval by the County Highway Department, upon receipt by Zoning of a soil test showing sites for installation of both initial and replacement private sewage systems, and upon approval and recording of a final certified survey map for the property. Modify the original request and allow creation of two, 1-acre lots on CTH G, one vacant, and one around the mobile home at N4656. These proposed lots are in the Town of Jefferson, part of PIN 014-0614-0632-000 (14.11 acres). These are considered prime ag land lots; therefore, rezoning is conditioned upon recording of an affidavit acknowledging use of all available A-3 zones for the property.
