The Tuesday, December 16, 1997, meeting of the City of Jefferson Common Council was called to order at 7:30 p.m. by Mayor Brawders. Members present: Ald. Wagner, Ald. Wendorf, Ald. Carnes, Ald. Polk, Ald. Hetzel, Ald. Oppermann and Ald. Beyer. Also present was City Administrator Schornack, City Attorney Scheibel, Police Chief Besel, City Engineer Ludwig and Administrative Assistant Sellnow.

BE IT RESOLVED by the Common Council of the City of Jefferson that the consent agenda for December 16, 1997, is hereby adopted.

The consent agenda for tonight includes:

Ald. Beyer, seconded by Ald. Wagner moved to approve Resolution No. 136. The motion carried unanimously.

An Ordinance to Amend Section 7.03(4)(e) of the Municipal Traffic Code Related to No Parking During School Zones.

The Common Council of the City of Jefferson do ordain as follows:

Section 1. Section 7.03(4)(e) is hereby amended to add the following no parking zone:

The south side of E. Church Street from the east right-of-way line of N. Sanborn Ave. to the west right-of-way line of N. German Ave. during the hours of 7:30 a.m. to 4:30 p.m. on School Days.

Section 2. This ordinance shall take effect upon passage and publication as required by law.

Ald. Oppermann, seconded (for discussion) by Ald. Beyer moved to approve Proposed Ordinance #30-97.

Ald. Beyer stated that the Regulatory Committee voted unanimously against this proposed ordinance. They felt that the school was handling the parking situation sufficiently on their own.

Ald. Oppermann stated that he still feels it is a safety issue.

Roll was then called on proposed Ordinance #30-97. On call of the roll, Ald. Wagner, Ald. Wendorf, Ald. Carnes, Ald. Polk, Ald. Hetzel, and Ald. Beyer voted no; Ald. Oppermann voted aye. The motion was defeated 6 to 1.

An Ordinance to Amend Section 7.03(4)(h) of the Municipal Traffic Code Related to No Parking Zones.

The Common Council of the City of Jefferson do ordain as follows:

Section 1. Section 7.03(4)(h) is hereby amended to add the following no parking zones:

The west side of the 100 Block of South Marshall Avenue.

Section 2. This ordinance shall take effect upon passage and publication as required by law.

Ald. Wagner, seconded by Ald. Beyer moved (for discussion) to approve Proposed Ordinance #31-97.

Ald. Wagner explained that in Regulatory Committee the consensus was to change the ordinance to No Parking on the east side of the 100 block of South Marshall Avenue and only during school hours.

It was explained that a new proposed ordinance would have to be drawn up to accommodate the proposed changes.

Roll was then called on the proposed Ordinance #31-97. On call of the roll, the ordinance was defeated unanimously.

PROPOSED ORDINANCE #32-97

An ordinance to amend Section Chapter 1, of the Municipal Code of the City of Jefferson, Related to Municipal Court.

The Common Council of the City of Jefferson do ordain as follows:

Section 1: Section 1.09(5) of the Municipal Code of the City of Jefferson is hereby amended as follows:

  1. SALARY. The salary of the Municipal Judge shall be fixed by the Common Council of the City of Jefferson, the Village Board of Johnson Creek, and the Town Board of the Town of Aztalan at $6,000 per year which shall be in lieu of fees and costs. No salary shall be paid for any time during the term during which such Judge has not executed the official bond or official oath, as required by (SS) 755.03, Wis. Stats., and filed pursuant to (SS) 19.01(4)(c) Wis. Stats. The municipalities may by separate ordinance allocate funds for the administration of the Municipal Court pursuant to (SS) 66.30 Wis. Stats. For the term ending April 30, 2000, the Village of Johnson Creek shall tender the sum of $4,500 per year, commencing May 1, 1998, and annually thereafter to the City of Jefferson. The Town of Aztalan shall tender $5 per case administered to the City of Jefferson. City of Jefferson shall pay the Municipal Judge's salary as set forth above. The City of Jefferson shall pay the Municipal Clerk's salary as budgeted from time to time.

Section 2. This ordinance shall take effect upon passage and publication as required by law.

Ald. Hetzel, seconded by Ald. Polk moved to approve Proposed Ordinance #32-97. The motion carried unanimously.

AMENDING COURT COSTS IN THE MUNICIPAL TRAFFIC CODE

Ald. Polk introduced Ordinance #33-97 for its first reading.

An ordinance to amend Section 25.04(3)(b) of the Municipal Traffic Code.

The Common Council of the City of Jefferson do ordain as follows:

Section 1. Section 25.04(3)(b) is hereby amended to read:

In addition to each base deposit amount set forth in this section, the total bond shall include the statutory penalty assessment and jail assessment, as amended from time to time by State Law, and Court Costs of $26. Court Costs of $26 shall also be assessed for all traffic citations issued in Municipal Court.

Section 2. This ordinance shall take effect upon passage and publication as required by law.

This is a first reading.

Ald. Wagner, seconded by Ald. Carnes moved to waive the second reading of proposed Ordinance #33-97. The motion to waive carried unanimously.

Ald. Wagner, seconded by Ald. Carnes moved to approve Ordinance #33-97.

City Attorney Scheibel explained that the State laws had been changed to allow municipalities to assess these additional court costs, and Judge Freeberg requested the change.

On call of the roll, the motion to approve proposed Ordinance #33-97 carried unanimously.

CREATING section 7.04(3) to MAKE pitzner parkway and spangler road 45 m.p.h. streets

Ald. Beyer introduced Ordinance #34-97 for its first reading.

An ordinance to create Section 7.04(3) of the Traffic Code of the City of Jefferson pertaining to Speed Limits.

The Common Council of the City of Jefferson do ordain as follows:

Section 1. Chapter 7.04(3) of the Traffic Code of the City of Jefferson is hereby created as follows:

7.04 SPEED LIMITS (3) The following streets shall be posted "45 M.P.H."

Section 2. This ordinance shall take effect upon passage and publication as required by law.

APPROVAL OF R. A. SMITH & ASSOC. CONTRACT AMENDMENT

Ald. Wendorf introduced Resolution No. 137.

BE IT RESOLVED by the Common Council of the City of Jefferson that the City Administrator is hereby authorized to execute Amendment No. 2 to the contract with R. A. Smith & Assoc. for services pertaining to the Jefferson dam, in an amount not to exceed $8,441.28.

Ald. Wendorf, seconded by Ald. Beyer moved to approve Resolution No. 137.

Ald. Wendorf stated that the Finance Committee voted unanimously to recommend this amendment. On call of the roll, the motion carried unanimously.

authorizing the borrowing of sewer utility funds

Ald. Carnes introduced Resolution No. 138.

BE IT RESOLVED by the Common Council of the City of Jefferson that the City Administrator is hereby authorized to transfer $55,000 from the Sewer Utility Fund to the General Fund for payment of architectural fees to Bray Architects Associates, and

BE IT FURTHER RESOLVED that the monies will be repaid at an interest rate of six percent (6%) to the Sewer Utility Fund from the proceeds of the 1998 bond issue.

Ald. Carnes, seconded by Ald. Wendorf moved to approve Resolution No. 138. The motion carried unanimously.

The City Engineer explained that this CSM was approved by the Plan Commission.

The motion to approve Resolution No. 139 was approved on a voice vote.

proposed land sales formula and covenant revisions for north industrial park

Ald. Oppermann introduced Resolution No. 140.

BE IT RESOLVED by the Common Council of the City of Jefferson that the proposed land sales formula for the North Industrial Park dated December 16, 1997, is hereby approved, and

BE IT FURTHER RESOLVED that the Mayor and City Administrator are hereby authorized to sign the revised North Industrial Park covenants.

Ald. Oppermann, seconded by Ald. Carnes moved to approve Resolution No. 140.

It was explained that this land sales formula and revised covenants were unanimously accepted by the JDC and the Finance Committee.

The motion to accept carried on a voice vote.

lease of steel shed to bert weisflog

Ald. Hetzel introduced Resolution No. 141.

RESOLUTION nO. 141

BE IT RESOLVED by the Common Council of the City of Jefferson that the City Administrator is hereby authorized to sign a lease agreement with Bert Weisflog for the lease of space in the 30' x 60' steel shed on the city-owned property located at 1171 N. Dewey Avenue until May 1, 1998, for $1,000.

Ald. Hetzel, seconded by Ald. Beyer moved to approve Resolution No. 141.

It was explained that the Finance Committee voted to lease the shed to Mr. Weisflog until May 1, 1998, for $1,000.

Ald. Wagner moved to change the lease amount to $600. The motion died for lack of a second.

On call of the roll: Ald. Carnes, Ald. Polk, Ald. Hetzel, Ald. Oppermann, and Ald. Beyer voted aye; Ald. Wagner voted no. Ald. Wendorf abstained. The motion carried 5 to 1, with one abstention.

transfer of fund balance from general fund to debt service for BOND paymentS

Ald. Oppermann introduced Resolution No. 142.

CITY OF JEFFERSON
RESOLUTION nO. 142

BE IT RESOLVED by the Common Council of the City of Jefferson that the City Administrator is hereby authorized to transfer $76,433 from the General Fund fund balance to the Debt Service Fund for Interest Payment on 1997 G.O. Bond and Prepay of Principal on the 1986 G.O. Bond.

Ald. Oppermann, seconded by Ald. Beyer moved to approve Resolution No. 142. The motion carried unanimously.

Chief Besel reported that there were 1,000 more complaints that came into the Jefferson Police Department in 1997.
