VILLAGE BOARD MEETING

August 3, 2000

The regular meeting of the Village Board was called to order at 6:30p.m. By Trustee O’Neil. The pledge of Allegiance was recited.

Trustees present: Fred Albertz, Robert Kasper, Arthur Ninmann, Carol O’Neil, Robert Remmel, and Elmer Stout. Absent: President John Maegli Also in Attendance: Administrator Gamble, Engineer Kunkel, Kathy with Attorney Hammes office, Clerk Dykstra, DPW Todd Hampton, Mrs. Morse, Mr. Boettcher, Tom Olszewski, Skyla Kanter, Lisa Strosin, Gary Colby, Gary Bleecker, Vicki Zick, Greg Schopp, Dave Anderson, Lyle Klockow, Lloyd Schultz of the Watertown Daily Times and several others.

CONSENT AGENDA

Personnel and Finance Committee

Contract Payments

A Kasper/Remmel motion carried 6-0 to adopt the committees’ recommendation to approve payment # 1 to Wondra Excavating for Sanitary Sewer Outfall Replacement in the amount of $75,739.05.

A Kasper/ Remmel motion carried 6-0 to adopt the committees’ recommendation to approve payments for the following contracts:

Payment #2 to Wondra Excavating for Sanitary Sewer Outfall Replacement in the amount of $113,613.08.

Payment #3 to Staab Construction for WWTF improvements in the amount of $254,515.00.

Payment #2 (Final) to G.M.S. Excavators for Doctors Court extension in the amount of $67,655.03.

Adoption of 2001 Budget schedule.

Final payment to E & H Earthmovers for Linmar Drive and S.T.H. "26" utility extension in the amount of $85,477.79 (retaining $25,000.00 in an escrow account for 10 years to cover possible future reconstruction of retaining wall).

PLAN COMMISSION

Menard’s site

A Kasper/Remmel motion carried 6-0 to accept the commissions’ recommendation to approve the building, the two freestanding signs in lieu of other signs in the development, and the concept center plan for Menard’s. The motion included that the north side of the lot labeled as landscape area be reserved for potential paved access for the neighboring lot. The front apron of the building shall provide a continuous 10-foot pedestrian area that shall be kept free of outdoor display materials. Such display materials may be located between the two exit door areas. A landscaped area along the building shall be a minimum of 5 feet deep. The drainage issues, utilities, and Hartwig Blvd have not been finalized.

Little Creek Preschool

A Kasper/Albertz motion carried 6-0 to accept the commissions’ recommendation to approve the CSM for Little Creek Pre-School/Saelens Corporation.

A Kasper/Stout motion carried 6-0 to accept the commissions recommendation to approve Little Creek Pre-School site plan.

A Kasper/Albertz motion carried 6-0 to accept the commissions recommendation to approve the conditional use for a commerical daycare, hours of opeartion will be 7 days a week and also propose the building to be used for other community functions such as: Boy/Girl Scout meetings, fitness classes, rental space for birthday parties, showers, special community meetings, senior citizen events, and other similar youth and civic activities.

MSI - CSM/SITE PLAN

A Kasper/Ninmann motion carried 6-0 to accept the commissions’ recommendation to approve the Certified Survey Map for MSI for the creation of 3 lots. These three lots will consist of 2 lots and 1 outlot (being the road and road right of way).

A Kasper/Albertz motion carried 6-0 to accept the commissions’ recommendation to approve the site plan, grading plan and interior road approval for MSI, LLC, contingent on a signed developers agreement.

Car Wash/Citgo

Keller Structure/Lloyd & Sylvia Davis

A Kasper/Stout motion carried 6-0 to accept the commissions’ recommendation to deny the site plan for the car wash.

A Kasper/Albertz motion carried to accept the commissions’ recommendation to approve the conditional use for the car wash.

Chapel Hill

A Kasper/Albertz motion carried 6-0 to accept the commissions’ recommendation to approve the Certified Survey

Map for Chapel Hill subject to the execution of a developer’s agreement requiring the extension of water and sewer to that property within 24 months from the signed developer’s agreement and if not in that time frame the Village has the right to extend the water and sewer and assess the cost to the property.

Ameritech Cellular Site Plan

A Kasper/Albertz motion carried 6-0 to accept the commissions’ recommendation to approve the Ameritech Cellular Antenna site plan contingent upon a signed lease agreement and inspection by Lang Tank.

Telecorp Cellular Site Plan

A Kasper/Remmel motion carried 6-0 to accept the commission recommendation to approve Telecorp Cellular Antenna Site plan contingent upon Kunkel Engineering’s confirmation that the structural integrity of the tower is not compromised, and a lease agreement is executed.

IMPROVEMENT & SERVICES

Hwy 26/DOT utility relocation

A Stout/Kasper motion carried 6-0 to accept the commission recommendation to allow Kunkel Engineering to put out bids for the relocation of watermains for Veterans Drive, Hartwig Drive and North of I-94, and complete in June of 2001.

Repairs to Cora and Depot Streets

A Remmel/Kasper motion carried 6-0 to accept the commissions’ recommendation to award the bid for repairs on Cora and Depots Streets to Fahrner Asphalt Sealers in the amount of $2,485.00.

PROTECTION & WELFARE

New ordinance

An Albertz/Kasper motion carried 6-0 to accept the committees’ recommendation to adopt a Negligent Operation of Motor Vehicle Ordinance.

One Hour Parking

An Albertz/ Ninmann motion carried 5-0-1 to accept the committees’ recommendation to approve two one-hour parking signs in front of 110 and 112 Milwaukee Street. O’Neil obstained from voting.

Class B Liquor License – Tio Juans

An Albertz/Kasper motion carried 6-0 to approve a Class B liquor license for Tio Juan’s, 310 Milwaukee Street.

Developer’s Agreement

A Kasper/Albertz motion carried 6-0 to approve the developer’s agreement for street maintenance and snow plowing with JC Landholdings, LLC for Chapel Hill.

Creation of Community Development Authority (CDA)

A Kasper/Ninmann motion to create a CDA was withdrawn. A Kasper/Ninmann motion to table until next month the creation of a CDA.

Historical Society

A Kasper/ Stout motion carried 6-0 to accept the request of the Johnson Creek Historical Society to hang prints in the Village Hall.

ORDINANCES

A Kasper/Ninmann motion carried 6-0 to accept the commission recommendation to change Village ordinance 15.08(2) to the proper reference of State Statute from SS 94.22 to SS 66.98.

RESOLUTION 16-00

A Remmel/Albertz motion carried to extend our sincere appreciation to Naomi MacDonald.

There was no other business

A Remmel/Stout motion carried 6-0 to adjourn at 7:18 p.m.

Historical Society

The Johnson Creek Historical Society will meet Monday, August 28th at 6:30 p.m. in the Library meeting room. The Speaker will be Bill Janke, well known Watertown historian, whose subject will be Timothy Johnson and his role in Johnson Creek history. The public is invited.

Compost & Brush

Just a reminder that Compost will be picked up on Monday, August 14 and Compost will be picked up the following Monday, August 21.

Maney-Miller

Maney-Miller is the New Inspection Company. Their office hours are to be Monday and Wednesday from 1:00pm until 2:30pm

Public Library

We are pleased to announce that the Johnson Creek Public Library is now a member of the LAUNCH Consortium. The Library Automation Network of Consortium Holdings includes the public libraries in the following communities: Beaver Dam; Lake Mills; Mayville; Waterloo; Watertown; and Waupun as well as its newwst member, Johnson Creek. At present, close to 400,000 items are listed in the joint catalog. Area residents can look at the catalog and then place holds and request items from any of the LAUNCH libraries. Those items are then sent to the Johnson Creek Public Library for pick up by our customers. For further information, stop in at the library today!

Also, please not: Effective Tues, September 5 winter hours will go into effect at the library. Winter hours are: Monday through Wednesday 12 noon to 8:00p.m.

Thursday through Friday 10:00a.m. to 6:00p.m.

Saturday 10:00 a.m. to 1:00p.m.

Labor day garbage and recycling pickup

Labor Day Monday, September 4, 2000. All collections will be one day late with Thurs. collection on Friday the 8th
