President Schacht called the Village Board Meeting to order at 7:00 PM on Tuesday, May 2,2000. The meeting is being held in compliance with Wisconsin Open Meetings Laws. Board Members present – John Lawson, Craig Schacht, Susan Phillips, Mark Stella, Valentin Blatz.
Others present – Leonard Witt, Janis Witt, Steve Pease, Dale Zastrow, Linda Horton, Kathy Flood, Beatrice Rowland, Nancy Wilkowski, Tony Friend, Sandra Kellner, John Belken.
The minutes of the April 5,2000 board meeting and minutes of the April 12,2000 Organizational Meeting were approved as presented.
The Treasurer’s Reports were approved as presented.
The Budget Comparisons were approved as presented.
There were no Fire Department Reports this month.
The Parks, Buildings, Grounds & Safety Committee (Lawson, Phillips) presented the following reports –
Trustee Lawson reported that the committee had a quote from Home Depot of $11,800.00 for materials for a new park building and had talked to people about volunteering help in constructing the building. Lawson stated that the committee was going to meet next Tuesday with Flood’s Remodeling for an estimated cost for repairing the existing building.
There were no reports from the Streets, Sidewalks, Sewer, Utilities & Recycling Committee (Phillips, Lawson).
The Budget, Finance, Legal Affairs Committee (Blatz, Stella) have no reports this month.
The Personnel Committee (Stella, Blatz) has no reports this month.
There are no reports from the Public Works Department or the Wastewater Treatment Plant.
The Plan Commission submitted the following written report –
The Plan Commission was called to order by Chairman Schacht at 6:30 P.M. on Wednesday, April 26, 2000. The meeting was held at the Sullivan Village Hall, 500 Madison Ave. The meeting is being held in compliance with Wisconsin Open Meeting Laws. Plan Commission members present were Craig Schacht, Melanie Kircher, Joe Larson, Claire Stella and Vincent Blatz. Absent were Nancy Wilkowski and Neal Smith. Others present were Clerk/Treasurer/Zoning Administrator Horton, Deputy Clerk/Treasurer Stoeckler, Brian Udovich, John Belken, John Lawson and Valentin Blatz.
Brian Udovich, representative of Ruekert/Mielke, the Village of Sullivan’s engineering firm, was present to discuss his technical review of Green Meadows Subdivision Preliminary Plat. Mr. Udovich had many concerns (which are attached to the original minutes) but the major concerns were:
John Belken, of Belken Engineering, was also present to discuss his submitted plans on the Green Meadows Subdivision. Mr. Belken stated he is aware of the need for DNR approval but would like an approval of the preliminary plat of Green Meadows by the Plan Commission prior to obtaining the approval and necessary permits by the DNR. It could get costly for the current owner of the property to continue with DNR approval and then have the Village deny the plans at a later date. Mr. Belken stated the proposed development site soils have not been disturbed since the last boring tests in 1986 and sees no reason to do them again, especially every lot. On the issue of the two floodlines Mr. Belken stated that according to FEMA one was erroneous and is why only one is now being shown.
Chairman Schacht informed Mr. Belken the Village has already backed this project by investing in upgrading our current Wastewater Treatment Plant to facilitate the proposed development. The Village cannot at this point give approval on the design aspect. Mr. Schacht and Mr. Larson are concerned about the amount the fill that is going to be needed in this area. Is it going to be at the cost of the current owner/developer or the potential purchaser of these lots? Mr. Schacht stated the Plan Commission does not have enough to go on to make any type of recommendation to the Village Board at this point and time.
Mr. Belken stated he needs to submit 3 different plat designs to the DNR for approval. Mr. Schacht informed Mr. Belken that he’d need to submit the same three designs to the Village Board for their review and determination at the May 2, 2000 meeting. Mr. Schacht also stated he would like Mr. Belken to start having Village staff review meetings with the Village Engineer and Zoning Administrator prior to formally submitting any plans to the Plan Commission. This would alleviate most of these issues being discussed at the Plan Commission level. When the plans are submitted to the Plan Commission they would have all these issues taken care of in one way or another. Mr. Belken agreed.
Motion was made by Mr. Schacht to recommend that the Village Board deny the preliminary engineering plans submitted for Green Meadows Subdivision. Seconded by Mr. Larson. Motion carried (5-0).
Motion was made by Mr. Schacht to adjourn. Seconded by Mr. Blatz. Motion carried (5-0). Meeting adjourned 7:27 P.M.
The village board discussed the Plan Commission report. John Belken explained to the board that the developer has to send to the DNR at least 3 subdivision design alternatives for an NR103 Report. This report is used by the DNR to determine disturbance of wetlands by a developer and whether the DNR will grant a variance. The Village Board had previously approved an oval street and Belken Engineering wanted to know if the DNR proposed cul-de-sacs as an option, if the board would approve that design. The developer does not want to spend approximately $30,000 in costs for DNR approval if the village board will not consider other options than the oval design. A lot of discussion took place. President Schacht asked the board individually the question – Are you open to a cul-de-sax option, if necessary? The response - Stella-yes, Lawson-yes, Blatz-yes, Phillips-yes, Schacht-yes.
Motion by Lawson to accept the recommendation of the Plan Commission Report. Seconded by Blatz. All board members voted yes. Motion Carried.
The board discussed the building inspector contract. Trustees Stella and Blatz stated they talked to Tom Marks and he would work without a contract. The board did not act upon the contract and will work with Tom Marks without a contract.
The board had no questions regarding the monthly building inspection report.
The following appeared before the board under the classification ‘Citizen Participation’ –
President Schacht mentioned that some of the driveway located at 729 Palmyra Street is on village property after a survey was done. The property has been used for a driveway for many years, and the board should discuss the possibility of quit claiming village alley portion to the property. Nancy Wilkowski stated that if that is done, at the same time all the alley property in back of the houses on Palmyra Street should be vacated, and turned over to the adjacent property owners. President Schacht stated it would be easier to abandon the alley, rather than vacate the alley. No board action was taken.
Tony Friend wanted to express his concern on several different matters. He is concerned about the lack of presence of law enforcement within the village. He is concerned with the excessive speeding of vehicles within the village, and he is concerned with the juvenile problems. The board told him that over the last two months, there has been more presence by the Jefferson County Sheriff’s Department, and that an officer has been to the past two village board meetings. The board stated that the village board and sheriff’s department is addressing those concerns.
Tony Friend also stated that he has received a parking citation for parking on Main Street, which he objects to. The board reported that there is no parking on Main Street from 2:30 AM to 6:00 AM. Tony stated that the park parking area for the apartments are full a lot of time. The board reported that the owner of the property is to provide parking stalls for their tenants. The board told Tony Friend to talk to the owner of the property. The board told Tony that if unauthorized vehicles are parked in the back parking spaces, the owner could have them towed.
Kathy Flood reported that the street sweeper tore up blacktop and wanted to know if the holes were going to get filled. Trustee Lawson stated that Bill Mattke is waiting for "hot Patch" to fill the holes.
Linda Horton wanted to know what the board is or has been doing about the debris of the property on Front Street owned by Tom Geiger that burned. Has he been ordered to clean it up by the board? Has he been given a time limit? Has the health department been notified? Linda Horton stated the property burned about five months ago, and it is still not cleaned up. She wanted to know if the board considered a health hazard yet, and wanted to know about rats on the property.
President Schacht stated that the DNR is being notified, and the Village Attorney may be contacted. Linda Horton wanted to know when these people were going to be notified.
Dale Zastrow wanted to know concerning the Tom Geiger property on Front Street, if someone gets hurt because the property is not cleaned up, if the village is liable. He also asked if the village was going to clean up the mess, if Tom Geiger did not. President Schacht stated the village could take legal action and get a court order to clean it up and charge Tom Geiger. But President Schacht stated how long will it take in the court systems.
Nancy Wilkowski wanted to know what the board was doing on the noise and dust at Woodcycle on Front Street. President Schacht said that Woodcycle is looking into alternatives.
Linda Horton asked the fire chief what kind of fire hazard Woodcycle presents with all of the piles of wood chips stored in the back of the property. She suggested the board should take a look. If there were a fire, it would take that whole end of the village.
Beatrice Rowland wanted to know what the village planned with the area where the new light pole was placed by the parking lot and Pourman’s Pub & Grill. Trustee Phillips stated that a shrub and blocks will be placed there.
Sandra Kellner appeared before the board concerned about the speeding of vehicles, in particular trucks, on Palmyra Street. President Schacht reported that options would be hiring part time officers from the sheriff’s department, and asking the sheriff’s department to monitor Palmyra Street more.
The board addressed the following Unfinished Business –
The results of the survey for times for the businesses to meet with the sheriff’s department were presented. The most favorable times were Monday, Tuesday, or Wednesday nights after 6:00 PM. Trustee Lawson and Trustee Blatz to chair this and to make a decision as to what night. When they come up a several days, the Clerk/Treasurer will call Officer Aasen to see if the date is okay with him.
New Business addressed by the board follows –
The Board of Review will be held Wednesday, May 10,2000 from 7:00 PM to 9:00 PM. at the village hall.
The Clerk/Treasurer presented the board with copies of the Statement of Sewer Service Charges for 1999. Horton explained the report gets filed with the Department of Revenue yearly. No board action is needed.
Motion by Schacht to send Wendy Stoeckler and Dale E. Horton to the Virchow Krause Utility Training Seminar to be held on May 23,2000 in Pewaukee. Seconded by Phillips. All board members voted in favor. Motion Carried.
Clerk/Treasurer Horton submitted a proposed Business Plan of Operation Form to the board for review. Building Inspector Tom Marks had submitted 2 samples to the Clerk/Treasurer. Horton combined the best of both, and that is what is being proposed. The board wants this item tabled until the next monthly meeting.
The board addressed the following Miscellaneous Business –
Motion by Schacht to send Mark Stella to the "Smart Growth" Comprehensive Regional Planning Conference to be held in Middleton on Friday, May 12,2000. Seconded by Phillips. All board members voted in favor. Motion Carried.
Clerk/Treasurer Horton reported to the board that the Certification of Continued TID Value Increment was sent to the Department of Revenue. Horton reported to the DOR that No Increment should be certified to the Village of Sullivan because the village has received aggregate tax increments in an amount equal to the aggregate of all project costs under the project plan and any amendments to the project plan.
Clerk/Treasurer Horton also reported that the status of the TID District required to be sent to all taxing jurisdictions by May 1,2000 have sent.
An update on the Census 2000 Initial Response Rates show the Village of Sullivan at 73%, behind Jefferson County as a whole, and 27% below what should be the census.
The board received correspondence from Charter Communications in regard to the new upgrades done within the village, and that cost 2,500,000. Therefore, effective June 1,2000 the Broadcast Basic rate will be adjusted from $11.28 to $11.65 per month and the Expanded Basic rate will be adjusted from $22.47 to $25.05 per month.
The Village of Sullivan has been subpoenaed to appear in court regarding a juvenile vandalism case.
The board had no questions or comments regarding any correspondence from the League of Wisconsin Municipalities.
Trustee Lawson wanted to know if President Schacht had contacted the attorney regarding the rezoning of I-1 property to B-1 Zoning. President Schacht said not as yet, but will.
